The Ho Chi Minh City People’s Committee has issued a plan to implement Government Decree No. 75/2025/ND-CP, dated April 1, 2025, detailing the implementation of the National Assembly’s Resolution No. 171/2024/QH15 on piloting commercial housing projects through agreements on land use rights or existing land use rights in the city.

The plan aims to concretize and effectively implement Resolution 171 and Decree 75, ensuring synchronization, unity, and comprehensiveness among departments, the People’s Committee of Thu Duc City and district authorities in their execution. It also defines the tasks, deadlines, and responsibilities of relevant organizations and individuals involved.

Accordingly, departments, branches, and localities are responsible for thoroughly executing the plan, ensuring progress, and closely coordinating with the Department of Agriculture and Environment and related units. Should any difficulties or obstacles arise, these units must promptly provide feedback for guidance or report to the Ho Chi Minh City People’s Committee for consideration and direction. Periodic reporting, triennial reviews, and five-year summaries are mandated per Clause 5, Article 5 of Resolution 171.

The Department of Agriculture and Environment has been assigned to take the lead in advising the Ho Chi Minh City People’s Committee to establish an inter-branch working group and a support group to review and assess proposed pilot project sites. Additionally, this department will monitor, inspect, and urge the implementation of the plan. They will also compile and submit reports to the Ho Chi Minh City People’s Committee and forward them to the Ministry of Agriculture and Environment and the Government.

According to Decree No. 75/2025/ND-CP, organizations intending to pilot commercial housing projects through agreements on land use rights must submit a set of documents to the provincial-level land management agency. The dossier comprises a registration form (sample No. 02 in the Decree’s appendix); a copy of documents proving existing land use rights, if applicable; and an extract of the map or diagram indicating the proposed pilot project site’s location.

Within 15 days from the registration deadline, the provincial-level land management agency will scrutinize and assess the conditions and criteria of the proposed pilot project sites. They will then establish a list of expected pilot project sites and submit it to the provincial People’s Committee for approval.

Subsequently, the provincial People’s Committee will present the approved list of expected pilot project sites to the provincial People’s Council for ratification, coinciding with the approval of the list of projects and works requiring land retrieval.

Once the provincial People’s Council ratifies the list, the provincial People’s Committee will publicly announce it on their electronic portal and the website of the provincial land management agency within three working days. They will also issue a notification regarding the approval of real estate business organizations to undertake the pilot projects and instruct the land management agency to notify cases where projects do not meet the requirements for inclusion in the list.

The notification process should be completed within five working days from the announcement of the expected pilot project sites list.

Upon receiving approval for investment policies and investors, real estate business organizations will proceed with other procedures to implement the pilot projects as stipulated by laws on investment, construction, housing, real estate business, land, and other relevant legal regulations.
