Mr. Nguyen Toan Thang, Director of Ho Chi Minh City’s Department of Agriculture and Environment, has submitted a report to the Ho Chi Minh City People’s Committee, the Ho Chi Minh City Inspectorate, the Ho Chi Minh City Department of Home Affairs, and the Ho Chi Minh City Real Estate Association (HoREA) regarding a complaint filed on February 14 by several real estate enterprises about the Ho Chi Minh City Land Registration Office’s handling of certificate issuance procedures for certain projects.
According to the report, after receiving the complaint related to the settlement of applications for land-use right certificates by the Ho Chi Minh City Land Registration Office for four enterprises, including Phu My Hung Development Company Limited, Limited Liability Biotech and Medical Equipment Manufacturing Company, SIS Vietnam International Stroke Services Joint Stock Company, and Saigon Infrastructure Development Joint Stock Company, the Inspectorate of the Department of Natural Resources and Environment (now the Inspectorate of the Department of Agriculture and Environment) invited the aforementioned enterprises to a meeting.
However, the Limited Liability Biotech and Medical Equipment Manufacturing Company did not attend. During these meetings, the Ho Chi Minh City Department of Agriculture and Environment’s Inspectorate took note of the opinions of the complaining enterprises.
At the meeting, Phu My Hung Development Company Limited and SIS Vietnam International Stroke Services Joint Stock Company affirmed that they did not participate in signing the complaint and stated that they had not encountered any difficulties or bureaucratic obstacles during the process of obtaining the certificates. These enterprises mentioned that they were guided to submit their applications online and received proactive support from the land registration authority.

The Ho Chi Minh City Department of Agriculture and Environment stated that several applications were delayed due to various objective reasons. For instance, the application for land-use certificates for purchasers at the Happy Valley R12 project of Phu My Hung Development Company Limited, submitted on March 30, 2023, was only finalized on November 8, 2024, as it was one of the 37 projects for which the company was in the process of applying for certificates for homebuyers.
Similarly, some projects within the 63-hectare land area faced financial obligation issues, causing the tax authority to temporarily halt the collection of registration fees, which led the Ho Chi Minh City Land Registration Office to scrutinize and categorize the projects into groups that met the conditions for granting certificates and those that did not.
Likewise, the applications of the Limited Liability Biotech and Medical Equipment Manufacturing Company and SIS Vietnam Joint Stock Company are pending the opinions of competent authorities or the fulfillment of financial obligations.
In the case of Always Limited Company in Tan Thuan Export Processing Zone, the file was previously under review due to delayed land use, and only after the company completed construction and accepted the work, the information on the registration for transfer was updated.
The Ho Chi Minh City Department of Agriculture and Environment also clarified that in 2023-2024, the Ho Chi Minh City Land Registration Office had to receive and process a large volume of applications related to inspection and investigation conclusions, including numerous documents requesting the preservation of legal status and temporary suspension of real estate transactions related to major cases, significantly impacting the overall processing progress.
Additionally, staff resignations, job rotations, staff shortages, and a sense of apprehension about responsibility have contributed to delays in processing some applications.
To address these issues, the Director of the Ho Chi Minh City Department of Agriculture and Environment has instructed the Ho Chi Minh City Land Registration Office to urgently review, compile statistics, and develop a plan to resolve all pending applications by June 30, 2025.
Furthermore, efforts will be made to accelerate administrative procedure reform, promote information technology applications, and establish a database connection between the tax and natural resources sectors to reduce application processing time.
The Ho Chi Minh City Land Registration Office aims to process 38,000 applications for certificates for homebuyers in 2025 as per the issued plan.
