Director of the Ho Chi Minh City Department of Agriculture and Environment, Mr. Nguyen Toan Thang, has submitted a report to the Ho Chi Minh City People’s Committee, the Ho Chi Minh City Inspectorate, the Ho Chi Minh City Department of Home Affairs, and the Ho Chi Minh City Real Estate Association (HoREA) regarding a complaint filed on February 14 by several real estate enterprises about the Ho Chi Minh City Land Registration Office and their handling of certificate application dossiers for a number of projects.

Accordingly, after receiving the complaint related to the settlement of dossiers for granting land use right certificates by the Ho Chi Minh City Land Registration Office for four enterprises, including Phu My Hung Development Co., Ltd., Limited Company of Biotechnology and Medical Equipment Factory, SIS Vietnam International Stroke Services Joint Stock Company, and Saigon Infrastructure Development Joint Stock Company, the Inspectorate of the Department of Natural Resources and Environment (now the Inspectorate of the Department of Agriculture and Environment) invited the above-mentioned enterprises to work.

However, the Limited Company of Biotechnology and Medical Equipment Factory did not attend. At the working sessions, the Ho Chi Minh City Department of Agriculture and Environment recorded the opinions of the enterprises that submitted the complaint. At the meeting, Phu My Hung Development Co., Ltd. and SIS Vietnam International Stroke Services Joint Stock Company affirmed that they did not participate in signing the complaint and also stated that they did not encounter any difficulties or red tape during the process of applying for the certificate. The enterprises mentioned that they were guided to submit their dossiers online and received active support from the land registration agency.

The Ho Chi Minh City Department of Agriculture and Environment stated that some dossiers were delayed due to various objective reasons. For instance, the dossier for granting certificates to home buyers in the Happy Valley R12 project of Phu My Hung Development Co., Ltd., submitted on March 30, 2023, was only completed on November 8, 2024, as it was one of the 37 projects for which the company was in the process of submitting dossiers for granting certificates to home buyers.

Similarly, some projects in the 63-hectare land area faced financial obligation issues, causing the tax agency to temporarily suspend the collection of registration fees, which led to the Ho Chi Minh City Land Registration Office having to review and categorize the projects into those that met the conditions and those that did not. The dossiers of the Limited Company of Biotechnology and Medical Equipment Factory and SIS Vietnam Joint Stock Company were also pending the opinions of competent authorities or the completion of financial obligations.

Meanwhile, the dossier of Always Limited Company in Tan Thuan Export Processing Zone was previously under consideration due to delayed land use, and it was only after the company completed construction and accepted the work that the dossier was updated with registration information for the transfer.

The Ho Chi Minh City Department of Agriculture and Environment also stated that in 2023-2024, the Ho Chi Minh City Land Registration Office had to receive and process a large number of dossiers related to inspection and investigation conclusions, including many documents requesting the maintenance of legal status and temporary suspension of real estate transactions related to major cases, which significantly affected the overall progress.

In addition, the departure of a significant number of officials, job rotations, staff shortages, and a sense of apprehension about responsibility have resulted in delays in some dossiers. To address this situation, the Director of the Ho Chi Minh City Department of Agriculture and Environment has directed the Ho Chi Minh City Land Registration Office to urgently review, compile statistics, and develop a plan to resolve all pending dossiers by June 30, 2025.

At the same time, they are instructed to intensify administrative procedure reform, apply information technology, and establish a database connection between the natural resources sector and the tax sector to reduce dossier processing time. The Ho Chi Minh City Land Registration Office aims to settle 38,000 dossiers for granting certificates to home buyers in 2025 as per the issued plan.
