BID PROTEST RESOLUTION: A CASE STUDY OF THE HCMC-THU DAU MOT-CHON THANH HIGHWAY PROJECT

Today (May 26), the People’s Committee of Binh Phuoc province requested the provincial Project Management Unit to report on Son Hai Group’s petition regarding the construction package of the HCMC-Thu Dau Mot-Chon Thanh Expressway passing through Binh Phuoc.

The People’s Committee of Binh Phuoc province directed the provincial Project Management Unit to work directly with the contractor to handle and resolve Son Hai Group’s petition.

SON HAI GROUP PROTESTS AGAINST BIDDING RESULT OF THE 17,000 BILLION DONG PROJECT

Earlier, on the same day, on their official fanpage, Son Hai Group shared a document sent to the Binh Phuoc Province Project Management Unit, protesting the selection of the construction contractor for the HCMC-Thu Dau Mot-Chon Thanh Highway project. Son Hai Group expressed their objection to being excluded from the bidding process for the aforementioned project, despite offering the lowest bid among five contractors. The Binh Phuoc Province Project Management Unit is the investor of this project.

According to the document published by Son Hai Group, on March 17, the investor conducted an open online bidding process. The starting price set by the investor was over 880 billion VND. Subsequently, five enterprises participated in the bidding process. Specifically, Son Hai Group’s bid was over 732.2 billion VND, Cienco 4 Group’s bid was over 800.6 billion VND, IB2500057961 Joint Venture’s bid was over 804 billion VND, Binh Phuoc Expressway Joint Venture’s bid was over 836 billion VND, and HCM-TDM-CT Joint Venture’s bid was over 866 billion VND.

Based on the above bids, Son Hai Group’s proposal offered the highest cost savings of 148.4 billion VND, while the other enterprises offered lower savings. Notably, the HCM-TDM-CT Joint Venture offered the lowest savings of just over 14 billion VND.

However, on May 22, the investor surprisingly selected the HCM-TDM-CT Joint Venture (comprising Truong Son Construction Corporation and NTV Thanh Phat Trading Services and Construction Co., Ltd.) as the winning bidder, despite their bid being the highest. Son Hai Group expressed their astonishment at this decision, especially considering that the other bidders who were excluded are leading and reputable enterprises in Vietnam’s transport infrastructure sector, including Cienco 4 Corporation, Vinaconex, Deo Ca Construction Corporation, and Son Hai Group. The reason given by the investor for disqualifying Son Hai Group and the other enterprises was their failure to meet the technical requirements of the package.

In response, Son Hai Group has formally protested the investor’s decision, sending a petition to the People’s Committee of Binh Phuoc province for resolution in accordance with the Bidding Law, and has also forwarded the document to relevant authorities for further examination and clarification.

Regarding this issue, the Binh Phuoc Province Project Management Unit (the project investor) stated that they have not received any official petition from Son Hai Group through either postal or the national bidding network. They only became aware of the information through social media and are currently preparing a quick report to submit to the People’s Committee of Binh Phuoc province.

The leadership of the People’s Committee of Binh Phuoc province affirmed that after receiving the report on the incident and the results of the meeting with Son Hai Group, they will provide official information to the press.

The HCMC-Thu Dau Mot-Chon Thanh Expressway, spanning Binh Duong province, is approximately 52km long. The highway is designed with six lanes and a speed limit of 100 km/h. Specifically, Phase 1 of the project is implemented under the Public-Private Partnership (PPP) model, featuring four expressway lanes and continuous emergency lanes, with a road width of 25.5m. The total investment for this project is estimated at 17,400 billion VND, with a construction period of 36 months, expected to be completed by 2027.

In late December 2024, the People’s Committee of Binh Phuoc province inaugurated the construction of the HCMC-Thu Dau Mot-Chon Thanh Expressway section passing through Binh Phuoc. This section is 6.6km long, starting at the boundary between Binh Duong and Binh Phuoc provinces and ending at National Highway 14 in Chon Thanh town, Binh Phuoc province. The project is invested in by the Binh Phuoc Province Project Management Unit.

This project is funded by the state with a total capital of 1,474 billion VND, including 1,000 billion VND from the central government and 474 billion VND from local funds. The construction period is scheduled from 2024 to 2026.
