On May 26, the People’s Committee of Binh Phuoc Province directed the provincial Project Management Unit for Transport Construction Investment to directly contact the leadership of Son Hai Corporation regarding the petition related to the bid package for the construction of the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway passing through the province.

The investment project for the construction of the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway is a key north-south transport axis for Binh Duong and Binh Phuoc provinces, connecting several important transport routes. The section passing through Binh Phuoc Province is approximately 7 km long. The announcement of the bidding results for the construction package for the Binh Phuoc section has sparked controversy.

The bid package, valued at over VND 880 billion, attracted five reputable contractors. Son Hai Corporation, based in Quang Binh Province, bid VND 732.2 billion (a 16.85% discount), saving VND 148 billion for the state budget. However, on May 22, the Binh Phuoc Transport Construction Investment Project Management Board (the investor) announced that the Ho Chi Minh City-Thu Dau Mot-Chon Thanh Expressway Joint Venture won the bid at VND 866.4 billion, saving only about VND 14 billion.

In an interview with Nguoi Lao Dong newspaper, Mr. Le Thanh Huong, Director of Son Hai Corporation, said that they had sent a petition to the investor and the People’s Committee of Binh Phuoc Province to request clarification of the bidding evaluation process to prevent waste and ensure transparency.

“We have implemented numerous key projects for the country, and none of them have been rated low in quality. In this bid, we even committed to a 10-year warranty for the project, the longest among the bidders, but we were still disqualified for unclear technical reasons,” said Mr. Huong. He added that if the issue is not satisfactorily resolved, Son Hai Corporation will take legal steps to protect its legitimate rights.

The People’s Committee of Binh Phuoc Province has requested the provincial Project Management Unit for Transport Construction Investment to report on the matter for resolution. Mr. Dinh Tien Hai, Director of the Binh Phuoc Transport Construction Investment Project Management Board, affirmed that the unit has not received any official petitions from Son Hai Corporation through the official document route or the national bidding network but only through social media. The Project Management Board is preparing a report to submit to the People’s Committee as per regulations.

According to Lawyer Vu Xuan Hai, Director of Dong Duong Law Company, Article 43 of the Law on Bidding stipulates that the selection of contractors must ensure competition, transparency, and efficiency. “If the lowest bidder has proven capacity and experience but is still disqualified without a clear reason, the bidding evaluation process should be reviewed. In case of any violations or bias, a lawsuit can be filed to protect legitimate interests,” said Lawyer Hai.
