On May 28, the Management Board of Binh Phuoc Province’s Investment Construction Project clarified that the information regarding Mr. Vu Ngoc Tru, Head of the Bidding Specialist Group, using an expired practice certificate in early October 2023, was inaccurate in relation to the consulting services for selecting contractors for the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway Project (the section passing through Binh Phuoc Province).
According to the Management Board of Binh Phuoc Province’s Investment Construction Project, Mr. Tru’s practice certificate was issued in 2023 and is valid for five years, meaning it will only expire in 2028.

On the same day, Mr. Pham Van Trinh, Chief of Office of Binh Phuoc Provincial People’s Committee, stated that the Provincial People’s Committee had received a petition from Son Hai Group regarding the bidding package for the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway Project (the section passing through the province). The Provincial People’s Committee of Binh Phuoc has directed relevant departments to inspect and provide consultation to ensure a response to Son Hai Group in accordance with regulations.
According to the report from the Management Board of Binh Phuoc Province’s Investment Construction Project, the construction installation package for the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway, passing through Binh Phuoc Province, had Van Phu Consulting Company, located in Hanoi, as the consulting unit for preparing bidding invitation documents and evaluating bidding proposals.

On May 6, the Specialist Group (established by the consulting unit) submitted an electronic bidding proposal evaluation report (E-HSDT) to the Management Board of Binh Phuoc Province’s Investment Construction Project and publicly opened bids online. Five construction companies participated in the bidding process, including Son Hai Group.
The evaluation results showed that the E-HSDT of all five bidders were valid, and they possessed sufficient capacity and experience. The winning bidder was the HCM-TDM-CT Expressway Joint Venture (consisting of Truong Son Construction Corporation and NTV Thanh Phat Trading Services and Construction Co., Ltd.). The other four companies, including Son Hai Group, were unsuccessful in their bids due to technical evaluation results that did not meet the requirements.

Deeply aggrieved, the leadership of Son Hai Group sent a petition to the People’s Committee of Binh Phuoc Province, stating that their company had the capacity and experience, having successfully bid for and constructed key national expressway and infrastructure projects. In participating in the bidding for this expressway project, the group had fully met the technical requirements of the E-HSMT and committed to providing a 10-year warranty (an additional 5 years compared to the E-HSMT requirements), resulting in maintenance cost savings for the state during the operation phase.
Notably, Son Hai Group argued that they offered the lowest bid price, which could save the state budget nearly VND 150 billion, yet the investor chose the winning bidder, the HCM-TDM-CT Expressway Joint Venture.
“The investor not only disqualified us but also the three other bidders who ranked after us, all of which are well-known enterprises in Vietnam’s transport sector,” said the leader of Son Hai Group.
Son Hai Group believes that the selection of the contractor was inconsistent with the E-HSMT and the provisions of the Law on Bidding, adversely affecting the interests and reputation of the enterprise, as well as causing state budget losses.
Additionally, Son Hai Group asserted that upon checking the members of the specialist group on the “chungchidauthau.mof.gov.vn” system, they found that Mr. Vu Ngoc Tru, Head of the Specialist Group, had a bidding practice certificate that expired on October 18, 2023, and thus, did not meet the requirements of the Bidding Law.
Therefore, Son Hai Group requested the People’s Committee of Binh Phuoc Province to inspect and re-evaluate the capabilities of the members of the Specialist Group evaluating the E-HSDT, and to establish an independent, inter-sectoral specialist group, separate from the investor and the bidding organizer, to re-evaluate the E-HSDT, ensuring the goals of bidding competition, fairness, transparency, and economic efficiency. They also requested the formation of an independent, inter-sectoral specialist group to re-evaluate the bids to ensure transparency.
With a familiar presence in expressway projects, Son Hai Group has become synonymous with quality and assurance. The company’s signature guarantee signs, proudly displayed on the roads they construct, promise a 5-year or even 10-year warranty, a testament to their commitment to durability and excellence.
The investor affirms that they have not received any formal complaints regarding the results of the contractor selection for the Ho Chi Minh City – Thu Dau Mot – Chon Thanh expressway project.
Despite offering the lowest bid, Son Hai Group was unsuccessful in securing the contract for the Hochiminh City – Thu Dau Mot – Chon Thanh highway project, specifically for the section passing through Binh Phuoc province.
On May 22nd, the Binh Phuoc Province Project Management Authority for Construction Investment announced the selection of a contractor for the construction of a section of the Ho Chi Minh City – Thu Dau Mot – Chon Thanh Expressway passing through Binh Phuoc Province. The project has a value of over 880 billion VND. The winning bidder, a joint venture named Ho Chi Minh City – TDM – CT Expressway, secured the contract with a bid of over 845 billion VND.
As the lowest bidder for the Binh Phuoc Expressway project, Son Hai Group lodged a complaint after their bid was rejected. The authorities have since responded with a detailed explanation for their decision.
