According to regulations, land planned for auction, intended for payment under BT contracts, or created after compensation and site clearance can be leased for a short term, with a duration not exceeding 12 months. If an auction is not organized or a BT contract is not signed within this period, the lease may be extended up to a maximum of 12 months at a time, with the total lease period not exceeding 60 months.

For land without a decision on land allocation and not included in the annual auction plan, the lease term is set between 12 and 60 months. In the case of a land lease with a term not exceeding 60 months, the Ho Chi Minh City Land Development Center will terminate the contract and publicly select organizations or individuals to lease the land for a short term after the contract ends.
For leases with the remaining terms, the Ho Chi Minh City Land Development Center will consider extending the lease period for the next term, ensuring that the total lease period, including extensions, does not exceed 60 months.
The short-term land rental price is determined by the following formula: Starting price for short-term land rent/m2/month = Land price for calculating short-term land rent x Percentage rate (%) for calculating the rental price ÷ 12. The land price for calculating short-term land rent is based on the Land Price Table (in units of VND 1,000/m2). The percentage rate (%) for calculating the rental price ranges from 0.25% to 3%, depending on the area and location as stipulated by the Ho Chi Minh City People’s Committee in Decision 09/2025, dated January 20, 2025.
