The Ministry of Industry and Trade is seeking feedback from concerned units on the draft Government Decree on administrative sanctions for violations in commercial activities, production, trading of counterfeit and banned goods, and protection of consumer rights.

Accordingly, the maximum fine in the field of production and trading of counterfeit and banned goods and protection of consumer rights is VND 200 million for individuals and VND 400 million for organizations.
For example, instead of a fine of VND 30-50 million, individuals and organizations will be fined VND 70-100 million in case of counterfeiting goods with a quantity equivalent to that of genuine goods with a value of VND 30 million or more, or illegal profits of VND 50 million or more, without being subject to criminal liability.
The fine shall be twice the above-mentioned levels for the acts of manufacturing counterfeit goods or importing counterfeit goods or trading in counterfeit goods which are food, food additives, food processing aids, food preservatives, drugs, drug ingredients, without being subject to criminal liability; cosmetics, medical equipment, chemicals, detergents…
In addition to fines, there are supplementary penalties such as revocation of licenses or practice certificates for a period of 1 to 12 months or temporary suspension of operations for a period of 1 to 12 months; Confiscation of violating goods; destruction, and compulsory refund of illegal profits.
