The Ho Chi Minh City Institute of Resource Economics and Environment has sent a document to the City’s Party Committee Secretary and People’s Committee Chairman regarding a proposal to replace the construction permit with a registration as directed by the Prime Minister.
The Institute suggests that allowing registration instead of a permit would be a reasonable approach to facilitate the construction process while maintaining the state’s management role, especially in terms of the city’s architectural landscape.
According to the Institute, the previous Law on Construction had already eliminated the requirement for a construction permit for approved 1/500 scale planning, specifically the Law on Construction 2003/QH11. However, there are still many areas that lack uniformity in implementing this regulation.
To establish a consistent foundation for registering residential construction instead of obtaining permits in Ho Chi Minh City from July 1, 2025, onwards, the Institute makes two proposals to the City’s Party Committee Secretary and the People’s Committee leadership.

Streamlining the construction permit process would benefit homeowners.
Firstly, they suggest that the City’s Party Committee and People’s Committee direct the relevant departments to unanimously agree on allowing registration instead of a permit based on alley frontage and residential architectural regulations stipulated in Decision 56/2021/QD-UBND of Ho Chi Minh City. This should be implemented from July 1, 2025.
The procedure would be guided by a registration template issued by the People’s Committees of wards and communes, ensuring simplicity, speed, and completeness of information to facilitate supervision and completion certification for residents according to the established process. Any intentional violations of the registered construction plans by citizens will be handled according to the current law on construction violations.
Additionally, the Institute proposes considering an adjustment to increase the height of the structure by at least one floor for buildings with an actual width of more than 5.5 meters and a minimum length of 12 meters as specified in Decision 56/2021/QD-UBND. This adjustment aims to enhance land use efficiency in the context of urbanization and improved infrastructure over the past five years, without causing traffic congestion in urban areas.
