At the recent dialogue between the Prime Minister and enterprises and enterprise associations, Minister of Agriculture and Environment Do Duc Duy clarified several issues related to land access and production premises – one of the significant proposals from the business community.
Mr. Duy mentioned an essential innovation in Resolution 68 of the Politburo, Resolution 198 of the National Assembly, and Resolution 139 of the Government. It mandates that local authorities allocate land in industrial parks for high-tech enterprises, small and medium-sized enterprises, and innovative enterprises. The minimum allocation is 20 hectares or 5% of each industrial park’s area.
“This regulation facilitates enterprises’ access to land with existing infrastructure, reducing investment time and costs,” the Minister emphasized. He assured that his Ministry would collaborate with relevant ministries and sectors to elaborate on this regulation in guiding documents, providing the best support for enterprises.
The Ministry of Agriculture and Environment also proposed that ministries and sectors coordinate to resolve obstacles in land allocation for healthcare facilities, which will be further elaborated in the new guiding document.
Regarding the obstacles in Decree 71 and Decree 103, related to land pricing and land-related financial obligations, the Minister shared that these issues have been identified in practice. The Ministry is developing a decree amendment through an expedited process, expected to be submitted to the Government for issuance and take effect from July 1st. “Regarding these specific issues, I have agreed with the Minister of Finance to consider and incorporate them into this draft amendment,” said Mr. Duy.
In response to Mr. Nguyen Van De (Chairman of the Vietnam Private Hospitals Association – PV)‘s reflection on land access for private hospitals, the Minister shared that the 2024 Land Law introduces new regulations on auction and bidding mechanisms. If the land has not been cleared, there will be a bidding process to select investors; if it is cleared, a land-use right auction will be organized.
A notable new point is that if an enterprise pays land rent once, an auction will be applied; if paid annually, bidding will be used. “This distinction has caused confusion for local authorities in choosing the appropriate form,” Mr. Duy explained.
Additionally, the Law and decrees permit land allocation without auctions or bidding in certain cases, but it falls under the Prime Minister’s authority. To address this, the Ministry is drafting a decree on decentralization and devolution, transferring this authority to the Provincial People’s Committee Chairpersons. The decree is expected to take effect from July 1st, paving the way for investor designation in projects like private hospitals.
“In the long term, we are working on a Law amending and supplementing a number of articles of laws related to agriculture and the environment, with a scope of up to 17 specialized laws. The draft is expected to be submitted to the National Assembly at the October session to fundamentally address the current shortcomings,” shared Minister Do Duc Duy.
