Speaking at the Discussion between the Prime Minister and enterprises and enterprise associations on effective implementation of the Resolution No. 68-NQ/TW of the Politburo on private economic development, Minister of Agriculture and Environment Do Duc Duy highly appreciated Resolution 68/NQ-TW and stated that an important new point in the Resolution No. 68 of the Politburo, Resolution No. 198 of the National Assembly, and Resolution No. 139 of the Government is the requirement for localities to mandatorily allocate land funds in industrial parks for high-tech enterprises, small and medium-sized enterprises, and innovative start-ups. The minimum ratio stipulated is 20 hectares or 5% of the area of each industrial park. This regulation is conducive to enterprises accessing land with available infrastructure, helping to shorten investment time and cost.
The Minister said that the Ministry of Agriculture and Environment would closely coordinate with relevant ministries and sectors to concretize this content in the Government’s guiding documents, thus best supporting enterprises.
Regarding enterprises’ opinions on some difficulties and obstacles in implementing Decree 71 (on land price determination) and Decree 103 (on determining financial obligations related to land for enterprises), the Ministry is constructing a decree amending and supplementing several decrees in the field of land according to the abbreviated order and procedures, expected to be submitted to the Government for issuance and take effect from July 1st. Specifically, regarding the above-mentioned contents, the Ministry of Agriculture and Environment has agreed with the Minister of Finance on studying and accepting to include them in this draft amendment.
Concerning a proposal of an enterprise related to land access for private hospitals, Mr. Do Duc Duy said that the 2024 Land Law has a new point compared to the previous law: in case an enterprise pays land rent once for the entire lease term, a bidding process shall be applied. If the enterprise pays land rent annually, a tendering process shall be applied. This distinction has caused confusion for localities in choosing the form of application. To solve this problem, the Ministry is constructing a decree on decentralization and delegation of power, in which it has proposed transferring the above power from the Prime Minister to the Chairman of the Provincial People’s Committee. Accordingly, from July 1st, when the decree takes effect, cases of land allocation without auctions or tenders will be decided by the Chairman of the Provincial People’s Committee, creating more favorable conditions for investors – including private hospitals – to access land through the form of investor designation.
