The National Assembly recently passed Resolution No. 201/2025/QH15 (Resolution 201) on a pilot scheme for several special mechanisms and policies to promote social housing development.

Article 5 of Resolution 201 clearly stipulates the mechanism for appointing investors and approving investment policies, as well as appointing investors without bidding for social housing and armed forces’ housing projects that do not use public investment capital.

Specifically, based on the approved housing development program or urban and rural planning, or the identified land plot for social housing and armed forces’ housing development, the appointment of investors shall be carried out as follows:

In the case of projects that have been approved for investment or have equivalent legal documents, the competent state agency shall appoint investors without bidding.

From July 1st, 2025, social housing and armed forces’ housing projects will have investors appointed without bidding.

For projects that have issued Expressions of Interest and bidding documents for investor selection but have not received any evaluation results from interested investors by July 1st, 2025, the provincial People’s Committee shall decide whether to continue with investor selection in accordance with bidding laws or appoint investors according to Resolution 201.

In the case of projects that have not yet been approved for investment or have equivalent legal documents, the competent state agency shall approve the investment policy and simultaneously appoint the investor without bidding.

Resolution 201 specifies the authority to appoint investors, approve investment policies, and simultaneously appoint investors without bidding as follows:

The provincial People’s Committee shall appoint investors or approve investment policies and simultaneously appoint investors for social housing projects as mentioned above, except for cases specified in point b of this article.

The Ministry of National Defense and the Ministry of Public Security shall appoint investors or approve investment policies and simultaneously appoint investors for housing projects for the armed forces in accordance with the provisions of this Resolution, after obtaining written agreement from the provincial People’s Committee on the land plot for investment in housing construction for the armed forces.

The provincial People’s Committee, the Ministry of National Defense, and the Ministry of Public Security shall not delegate or authorize others to exercise the above authority.

According to Resolution 201, the condition for appointing investors is that they must meet the conditions for real estate business organizations as prescribed by law.

In case there are two or more investors registering to be the project owner, the criteria for prioritizing the appointment of investors include: experience in implementing housing construction projects; financial capacity to implement the project; and other criteria as prescribed by the Government.

Also, according to Resolution 201, the procedure for appointing investors, approving investment policies, and simultaneously appointing investors without bidding replaces the procedure for approving investment policies and the procedure for selecting investors prescribed in investment laws and other relevant laws.

The decision to appoint investors, the decision to approve the investment policy, and the simultaneous appointment of investors without bidding shall be the basis for land allocation, land lease, and land use purpose conversion.

According to experts, the appointment of investors should be based on the principle of prioritizing investors with extensive experience, strong financial capacity, and rapid implementation to ensure the progress and quality of projects and meet the demand for social housing for the people.

Many localities have not yet implemented social housing projects

According to a recent report by the Ministry of Construction on the results of the social housing development scheme, there are 679 social housing projects with a scale of over 623,000 units across the country. Of these, 108 projects have been completed, providing over 73,000 units; 155 projects have started construction with nearly 132,800 units; and 416 projects have been approved in principle with nearly 417,200 units. In the first four months of 2025, 15,614 units were completed, and construction began on 20 social housing projects with nearly 19,500 units. The Ministry of Construction reported that many localities are struggling to meet their targets, including Hanoi, Ho Chi Minh City, Can Tho, Phu Tho, Thai Nguyen, Quang Ninh, Binh Duong, Binh Thuan, and Thanh Hoa. Additionally, some localities have not yet implemented social housing projects, including Yen Bai, Son La, Ninh Binh, Nam Dinh, Ha Tinh, Quang Binh, and Quang Nam.
