The Ministry of Construction indicated that Hanoi-Bac Giang BOT Joint Stock Company was established by a consortium of investors. The consortium’s purpose was to implement the project to upgrade and renovate National Highway 1, the Hanoi-Bac Giang section, according to the signed BOT contract.

Meanwhile, Decree 108/2009 of the Government on investment in the form of BOT, BTO, and BT contracts, as well as the Law on Investment in the form of Public-Private Partnerships (PPP) in 2020, stipulate that PPP project enterprises are established solely for the purpose of signing and executing specific project contracts and do not have the function of proposing new projects.

Thus, the proposal by Hanoi-Bac Giang BOT Joint Stock Company to expand the Hanoi-Bac Giang expressway to eight lanes under the PPP model is inconsistent with current legal regulations regarding the functions and scope of operations of enterprises.

Earlier this month, Hanoi-Bac Giang BOT Joint Stock Company sent a document to the Ministry of Construction and the Vietnam Road Administration proposing the expansion of the Hanoi-Bac Giang expressway to meet the growing demand for transportation, improve service quality, and reduce traffic congestion and accidents.

The company stated that the current traffic volume at the toll station reaches approximately 53,500 vehicles per day and night, while the financial plan anticipated a maximum capacity of 46,000 vehicles per day and night. Due to an annual increase of about 11% in vehicle volume, the road is overloaded, frequently causing traffic congestion, posing accident risks, increasing transportation costs, and affecting the competitiveness of the region.

Hanoi-Bac Giang BOT Joint Stock Company proposed to establish an investment policy to expand the expressway to eight lanes. After approval by the competent authorities, the company will ensure efficient investment in the project.

The project to upgrade and renovate National Highway 1, the Hanoi-Bac Giang section, in the form of a BOT contract, is over 46 km long, designed as an expressway with four lanes, a road width of 33-34 m, and an operating speed of 100 km/h. The project has a total investment of over VND 4,100 billion, was put into operation in April 2016, and the toll collection period is 21 years.

According to the Road Network Planning for the period of 2021-2030, with a vision to 2050, the Hanoi-Bac Giang-Lang Son expressway is 153 km long and has 6-8 lanes. The entire route consists of three sections: the Phu Dong, Hanoi-Bac Giang section, which is 46 km long and planned to be expanded to 8 lanes; the Bac Giang-Chi Lang, Lang Son section, which is 64 km long and planned for 6 lanes; and the Huu Nghi-Chi Lang, Lang Son section, which is 43 km long and currently under construction with 4 lanes, expected to be completed by the end of this year.
