According to statistics from the Ministry of Construction, in the year following the implementation of Decree 90/2023 on road usage fee collection, payment, exemption, and management, 2024 marked a significant milestone as the total road usage fee collection surpassed the threshold of 14,000 billion VND. This substantial revenue stream has notably contributed to the annual state budget growth and provided a solid foundation for allocating increased funds towards the maintenance and upkeep of the nationwide road transport system.
However, during the implementation process of the Decree, new challenges and shortcomings have surfaced. One notable example is the issue of vehicles being subject to temporary seizure or detention for 30 days or more, as well as those that are past their registration inspection deadline but are still required to pay the road usage fees despite not being in use. Additionally, the fee structure for public transport buses (including those carrying students, factory workers, and eligible passengers under the bus subsidy policy) being categorized under the same rate as cars with fewer than 10 seats seems unreasonable and requires reconsideration.

Consequently, in a document submitted to the Ministry of Finance proposing amendments to Decree 90/2023, the Ministry of Construction suggested that vehicles subject to temporary seizure, detention, or continuous suspension of circulation for 30 consecutive days or more should be exempt from road usage fees. This suggestion stems from the fact that numerous vehicles have been temporarily seized or detained by authorities as evidence in cases related to smuggling, gambling, and traffic accidents, during which the vehicles were not utilizing the road transport system.
Furthermore, to ensure fairness for all vehicle owners, the Ministry of Construction proposed that all vehicles temporarily suspended from circulation for 30 consecutive days or more should be exempt from road usage fees, addressing feedback from various organizations and individuals regarding the current Decree’s limitation to only vehicles of transport businesses.

Additionally, the Ministry of Construction and Transport proposed that vehicles used for funeral services, including passenger cars accompanying the hearse, flower-carrying trucks, and photo-bearing vehicles, should be allowed to use roads free of charge. Previously, only funeral service providers were exempted from road usage fees, excluding many funeral-related businesses from this benefit.
Regarding the refund or offset of road usage fees already paid, the Ministry of Construction suggested the following amendment: For cars specified in Point c, Clause 2, Article 2 of this Decree, before taking the car for repair, the car owner must present the accident report with police confirmation and return the inspection stamp and certificate to the nearest inspection facility. This will provide a basis for refunding the fees after the car has completed the necessary repairs and re-inspection for continued circulation. In cases where these documents are damaged or lost in an accident, a confirmation letter from the police or insurance company related to the accident handling must be provided.
