The National Assembly is currently reviewing the draft Law on Amendments and Supplements to a Number of Articles of the Law on Handling Administrative Violations, which has garnered significant attention from delegates.

Notably, the current law stipulates that the procedure for administrative sanction without a written record is applicable in cases of warnings or fines up to VND 250,000 (for individuals) and VND 500,000 (for organizations).

This time, the proposed amendments suggest increasing the fine amounts to VND 1 million and VND 2 million, respectively. Many delegates expressed concern and requested careful consideration of this proposed increase.

Addressing these concerns, Minister of Justice Nguyen Hai Ninh explained that the proposed changes aim to simplify the administrative sanction procedure for individuals and organizations in violation.

By foregoing the written record, the sanction decision can be delivered promptly and conveniently, allowing violators to receive the decision on the spot, saving time and avoiding unnecessary travel. Mr. Nguyen Hai Ninh also emphasized that despite the increase, the maximum fine amount without a written record remains true to the nature of “minor violations and simplified procedures.”

Regarding the suggestion to consider limiting the fine amount when imposing administrative sanctions without a written record to four times the current amount, the drafting agency indicated that they will study and consider this feedback. They will also report to the Government and the Standing Committee of the National Assembly to finalize the draft law for the National Assembly’s consideration and decision.

Speaking to the media about issues related to this draft law, Minister of Justice Nguyen Hai Ninh shared that this law project follows a streamlined process and focuses on amending and supplementing provisions related to the reorganization and streamlining of local government organizations at two levels.

Continued Research and Practical Evaluation

Addressing concerns about the proposed increase in maximum fines not aligning with the income and living standards of the people, Mr. Nguyen Hai Ninh assured that the draft law presented to the National Assembly does not propose adjusting the maximum fine amounts in any field of state management. Instead, it reviews and supplements new areas not yet covered by the current law.

“This is to meet the requirements of state management in the new situation,” he explained. “For example, supplementing areas such as personal data protection, digital technology industry, and integrated management of marine resources and environment to provide a transparent and consistent legal basis for sanctions in these areas.”

Minister Nguyen Hai Ninh emphasized that increasing the maximum fine amounts is a significant matter with direct implications for citizens and businesses. Therefore, it will be subject to further research, practical evaluation, and comprehensive impact assessment.

The National Assembly is expected to vote on the Law on Amendments and Supplements to a Number of Articles of the Law on Handling Administrative Violations on June 25th.
