Vice President of the National Assembly, Nguyen Thi Thanh, has issued Guidance No. 1309/HD-UBTVQH15, outlining specific provisions regarding the organization and operations of the 15th National Assembly Delegation, and Provincial and Communal People’s Councils for the 2021-2026 term, following the 2025 administrative unit reorganization.
Key personnel will be appointed by the appropriate authorities
This guidance is issued in the context of a series of important resolutions and conclusions adopted by the Central Committee and the National Assembly to streamline organizational structures and administrative units, including Conclusion No. 150-KL/TW and 163-KL/TW of the Politburo, and Resolution No. 76/2025/UBTVQH15 and 190/2025/QH15 of the National Assembly.
Guidance 1309 aims to ensure the smooth functioning of the local government system by promptly completing the personnel arrangement and organizational structure immediately after the establishment of the new administrative units.

According to the guidance, the Standing Committee of the National Assembly will issue a resolution to appoint key personnel to positions such as Head and Deputy Head of the National Assembly Delegation; Chairman, Vice Chairman, and Head of Committees of the Provincial People’s Councils in the newly reorganized provinces and cities immediately after the National Assembly’s resolution on the reorganization of provincial-level administrative units in 2025 takes effect.
The Standing Committee of the Provincial People’s Council will issue a resolution to appoint personnel to positions such as members of the Provincial People’s Committee, Chairman, Vice Chairman, Head of Committees of the People’s Councils, and Chairman and Vice Chairman of the People’s Committees of the newly reorganized communal-level administrative units immediately after the resolution of the Standing Committee of the National Assembly on the appointment of key personnel of the Standing Committee of the Provincial People’s Councils takes effect.
The Standing Committee of the Communal People’s Council will issue a resolution to appoint members of the Communal People’s Committee for the newly reorganized communal-level administrative units immediately after the resolution of the Standing Committee of the Provincial People’s Council on the appointment of key personnel of the Communal People’s Councils takes effect.
Based on the personnel plan approved by the competent Party committee, the Provincial Party Committee Standing Committee in the localities after the merger or consolidation will promptly notify, urge, and direct the Standing Committee of the Provincial People’s Council and the Standing Committee of the Communal People’s Council in the newly reorganized areas to complete the appointment and personnel arrangement of the leaders of the local government in accordance with their competence.
No change in the number of personnel in the National Assembly Delegation and Provincial People’s Council
According to the guidance, the National Assembly Delegations in the provinces and cities after the reorganization will comprise all the delegates from the former administrative units. The organizational structure includes the Head of Delegation, Deputy Heads of Delegation, and National Assembly delegates. Notably, the number of full-time delegates remains unchanged.
Similarly, the Provincial People’s Councils in the newly reorganized provinces and cities will continue to function with the full complement of delegates, the Standing Committee, Committees, and delegations as before. The number of Vice Chairpersons, Heads of Committees, and Deputy Heads of Committees who are full-time officials will also remain the same as in the pre-reorganization administrative units.

The appointment of key personnel to positions such as Head of the National Assembly Delegation, Chairman and Vice Chairman of the People’s Councils, and Heads of Committees will be carried out by the Standing Committee of the National Assembly immediately after the reorganization resolution takes effect. The Standing Committee of the Provincial People’s Council will continue to issue resolutions to appoint the remaining officials, such as members of the Provincial People’s Committee and Deputy Heads of Committees, in accordance with their competence.
Regarding the organization of the Office of the National Assembly Delegation and Provincial People’s Council after the reorganization, the guidance requires that the merger must maintain the original organizational structure. After reaching an agreement with the Head of Delegation and the Standing Committee of the Provincial People’s Council, the provinces and cities will establish a new office based on the consolidation of the former offices.
The position, tasks, and organizational structure of the Office shall comply with Resolution No. 1004/2020/UBTVQH14. The leadership personnel of the Office shall include the Chief of Office and Deputy Chiefs of Office, who will be appointed after reaching an agreement with the Standing Committee of the Provincial People’s Council.
Notably, at the time of reorganization, the number of Deputy Chiefs of Office may exceed the prescribed limit, but within five years (by July 1, 2030), it must be adjusted to comply with the current regulations.
Communal People’s Council: Ensuring continuity and flexibility in organization
Regarding the Communal People’s Council, the guidance states that the Council for the 2021-2026 term in the newly reorganized communes/wards will comprise delegates from various sources. These include delegates from the former Communal People’s Council, delegates of the District People’s Council elected in the new commune’s territory, or those working in that area.
The Standing Committee of the District People’s Council will be responsible for reviewing and proposing a suitable plan for the arrangement of delegates, ensuring representativeness and reasonable composition. The appointment of delegates from these special groups will be decided by the Standing Committee of the Provincial People’s Council.
The guidance also clarifies that the delegates of the Communal People’s Council in the newly reorganized areas will continue to serve until the end of the 2021-2026 term, ensuring continuity and consistency.
The organizational structure of the Communal People’s Council includes the Standing Committee (Chairman, Vice Chairman, and Head of Committees), Committees of the People’s Council, delegations, and delegates. The number of Vice Chairpersons, Vice Heads of Committees, and full-time officials will be determined according to the Law on Local Government Organization (amended).
In this guidance, the Standing Committee of the National Assembly also requests localities to promptly implement personnel plans approved by the competent Party committee. The Provincial Party Committee Standing Committee in localities with new administrative units is responsible for directing the completion of the personnel arrangement for local governments at all levels, ensuring stable operations immediately after the reorganization resolution takes effect.
Another notable point is the regulation on determining the “term” of the People’s Council in the new administrative units. Accordingly, if the new unit retains the name of one of the former units, the term of the People’s Council will be considered consecutive. If the new unit has a different name or type, the term of the People’s Council will be counted anew (First Term).
Immediately after the key personnel are appointed, the Standing Committee of the People’s Councils at all levels shall convene the first session. The agenda of the session includes announcing the resolution on the appointment of key personnel, establishing Committees of the People’s Council, establishing the Office of the National Assembly Delegation and Provincial People’s Council, considering socio-economic development plans and budgets (if any), approving the schedule of regular sessions for 2025, and other contents as prescribed by law.
