Dong Nai Province’s Public Security Department on June 13th, issued an administrative fine of VND 80 million to Nestle Vietnam Co., Ltd., located in Bien Hoa II Industrial Park, Bien Hoa City. The fine was imposed for violations related to advertising and consumer rights protection.

Along with the fine, Nestle Vietnam was ordered to immediately implement remedial measures, including recalling all misleading and confusing advertisements for consumers. They were also instructed to rectify false or misleading information and remove advertisements from all media and formats that the company had utilized.

Nestle Vietnam is forced to recall and remove misleading product advertisements aimed at consumers.

According to the authorities, providing inaccurate and incomplete information on the packaging label of “Nestle Milo Barley Milk” and advertising through various media outlets misled consumers. This violates Point a, Clause 1, Article 10 of the Law on Consumer Protection.

By using words such as “the best,” “number one,” or similar phrases in their advertisements without providing legal documentation as required by government regulations, Nestle Vietnam violated Decree No. 38 on administrative sanctions for violations in the field of advertising.

The Public Security Agency also requested that Nestle Vietnam implement remedial measures within 10 days from the date of receiving the administrative sanction decision.

Previously, Dong Nai Provincial Public Security Department received a denunciation with signs of “cheating customers” happening at Nestle Vietnam. During the investigation and verification process, the Public Security determined that the act did not constitute a crime. The Provincial Public Security Investigation Agency decided not to initiate a criminal case as the elements of the “cheating customers” crime were not met.
