Dak Lak police are investigating irregularities in the leasing of a 4,732m2 plot of land in Krong Pac district.

On June 6, in connection with this case, the Krong Pac District People’s Procuracy approved the decision to prosecute Mr. Doan Xuan Binh, former vice chairman of the Krong Pac District People’s Committee, and Mr. Phan Xuan Lam, deputy head of the district’s Agriculture and Environment Division. The two defendants are being investigated for “violating land management regulations.”

According to initial investigation results, in 2014, Ms. Le Thi To Kha from Krong Pac district requested to lease an area at the vacant lot on Nguyen Thi Minh Khai street. The purpose was to build a wedding banquet hall, cafe, and karaoke facility.

Subsequently, the Krong Pac People’s Committee issued a decision approving the 1/500 Tan An Lake Central Park construction planning and announced a call for investment in the Tan An Lake Central Park project.

In June 2015, during the implementation process, Mr. Phan Xuan Lam, then-deputy head of the Natural Resources and Environment Division (now the Agriculture and Environment Division), appraised and advised Mr. Doan Xuan Binh to lease 4,732m2 of land to Ms. Le Thi To Kha.

The district issued two land use certificates in the Tan An Lake area to Ms. Kha, which contradicted the district’s land use planning for the 2011-2020 period and the 2011-2015 five-year land use plan that had been approved. This action violated Article 52 of the 2013 Land Law.

The area where the land was leased and land use rights were granted inappropriately has been developed with substantial constructions.

As reported by Tien Phong , in 2021, the Krong Pac District Inspectorate issued Conclusion No. 304, pointing out numerous violations in the leasing of this land plot.

In 2014, the District Party Committee agreed to the principle of leasing more than 4,700m2 of land to Ms. Le Thi To Kha for business purposes. However, the Natural Resources and Environment Division advised the People’s Committee to grant two land use certificates to Ms. Kha, with a lease term of 50 years and an annual land rent of VND 12,700/m2.

The inspection confirmed that the land plot is part of the planning for the Tan An Lake Central Park. The lease violated regulations. Upon reviewing the documents, the authorities discovered the absence of a demand assessment document, a lack of auction procedures, and non-compliance with the District Party Committee’s conclusion.

According to records, the leased land plot is in a prime location in the center of Phuoc An town, Krong Pac district. Substantial constructions, including a restaurant, a modern cafe, and a lake view, have been built on the site. The place attracts a large number of visitors, especially during holidays and festivals.
