Guidance on Handling Government Headquarters and Public Land after Administrative Unit Reorganization

This guidance, issued in Document No. 8380/BTC-QLCS on June 13, 2025, follows instructions from the Prime Minister in Official Dispatch No. 80/CĐ-TTg and requirements from the Central Internal Affairs Commission. The Ministry of Finance has been working with relevant ministries and agencies to establish inter-agency task forces that directly engage with local authorities to review and address challenges in managing public assets post-merger.

According to reports, many localities have been slow to act or have failed to develop specific plans for managing these assets. Some lack the necessary urgency, and there is a lack of coordination between levels and sectors, especially between local authorities and central agencies with assets in the area. The Ministry of Finance attributes the resulting situation of vacant and underutilized headquarters to this lack of coordination.

By the end of June, administrative units at the district level must complete the handover of all public assets, including headquarters, related documents, and files. After this deadline, the People’s Committees of the newly established provincial-level administrative units will be responsible for managing all handed-over assets. For properties assigned to local land development funds or housing businesses, the provincial People’s Committees must have concrete plans for their utilization to prevent idling.

If adjustments are required to already approved asset management plans due to changing circumstances, localities do not need to repeat the entire previous process. Instead, they should report to the competent authority and request adjustments according to current legal regulations. For changes in functionality, such as converting headquarters into infrastructure assets, localities should follow Article 13 of Decree No. 151/2017/NĐ-CP and related regulations on planning and land use.

The Ministry of Finance also emphasizes several points for special attention. Localities should be well-versed in the new regulations on standards and quotas for the use of public assets and the division of management authority. The formulation of asset management plans should involve coordination with central ministries and agencies, and if necessary, temporary headquarters can be handed over for immediate use, with the formal transfer completed within 30 days.

The Ministry also instructs localities to fully receive assets transferred by central agencies and proactively report any difficulties and obstacles encountered in the process for timely resolution, avoiding prolongation that may lead to wastefulness.
