According to a report by the Dong Nai Land Registration Office, to ensure consistency in land-related legal documents as the province transitions into a city, a meeting was held early June between the Dong Nai Land Registration Office and the Binh Phuoc Land Management Agency and Land Registration Office. The parties agreed on several matters, including residential land allocation limits for individuals, which vary depending on whether they reside in wards (250 sq. m), plain rural communes (300 sq. m), or mountainous communes (400 sq. m). The recognized land area for residential use also differs, ranging from 250 to 400 sq. m depending on the location.
No changes were made to the current equivalent regulations on the minimum area for transferring agricultural land use rights between the two provinces. Additionally, the parties proposed conditions and minimum areas for land subdivision and consolidation for each land type.
During the meeting, the localities reported difficulties and obstacles in implementing provincial regulations and the 2024 Land Law regarding land division, consolidation, and certification. One challenge pertains to the conditions for land consolidation, which require that consolidated land parcels have the same land use purpose, tenure, and payment method. If these aspects differ, simultaneous procedures for changing land use purpose, adjusting tenure, and modifying payment methods are necessary to ensure compliance with legal requirements.
Concluding the meeting, Vice Chairman of the Provincial People’s Committee, Nguyen Thi Hoang, noted that in October 2024, the Provincial People’s Committee issued Decision No. 63/2024/QD-UBND on authorizing land use right and ownership certification under the 2024 Land Law in the province. This decision has benefited thousands of cases involving land division, consolidation, and certification, protecting the rights of land users.
To further facilitate citizen services and ensure uniformity in implementing land-related legal provisions in the province, the provincial leaders instructed a review of existing provincial regulations with suggestions for adjustments as the province transitions into a city. The Dong Nai Land Registration Office was also instructed to reorganize its apparatus and area registration office branches. The branches will be responsible for the old district areas but will be redistributed to ensure balanced workload and efficient service delivery to the public.
