The National Assembly this morning passed the Law on Officials and Civil Servants (amended)

Minister of Home Affairs Pham Thi Thanh Tra said that the draft law has been edited to include 7 Chapters and 45 Articles (reducing 8 Articles). At the same time, based on the feedback received, the draft law reflects innovative thinking and creates a dynamic, transparent, and efficient legal corridor for the management of civil servants.

Allowing private sector professionals to take up management and leadership positions

The draft law has refined regulations to implement the policy of building a unified, interconnected, and coherent public service system from the central to the commune level, without distinguishing between commune and provincial levels.

The mechanism for attracting high-quality human resources and policies for talented individuals in the public service has been improved. This includes policies for two groups: high-quality human resources attracted to the public sector and talented individuals in the public service.

According to the draft law, the Government proposes three forms of attracting high-quality human resources from outside the public sector: recruitment into the civil service; signing contracts with exemplary entrepreneurs, excellent jurists and lawyers, experts, and scientists to perform certain tasks of leadership and management positions; and signing contracts with high-quality human resources to perform specialized and professional tasks.

The Law on Officials and Civil Servants (amended) introduces regulations on transitioning to a civil service management model based on job positions, with job positions as the central focus. This means that the recruitment, placement, evaluation, training, planning, and appointment of officials and civil servants will be based on the requirements of the job position and the results and products of their work.

Minister Pham Thi Thanh Tra also shared that the draft law encourages civil servants to develop their professional expertise without necessarily having to be appointed to leadership or management positions.

Entitled to additional income based on job position products

Article 10 of the Law stipulates the rights of officials and civil servants regarding salaries, bonuses, and other income-related regulations. It clearly states that officials and civil servants are entitled to salaries, bonuses, and other income according to the results and products of the job positions they hold, in line with the socio-economic development of the country and the locality.

Based on this regulation, the Government will direct the relevant agencies to research and define the standards for additional income (beyond the salary) based on the products of each job, ensuring that the income of officials and civil servants is commensurate with their results, efficiency, and productivity.

This regulation will motivate officials and civil servants to improve the quality of their work, ensuring that income corresponds to the value of labor, with the principle of “more work, more pay, less work, less pay.” It will also help address the issue of income equality.

The assessment and ranking of civil servants’ performance is another area with significant innovations in this amended law.

Based on the monitoring, evaluation, and ranking results, the competent agencies and organizations will consider and decide on the implementation of rewards, additional income regulations, and bonuses as per the regulations.

In cases where civil servants fail to fulfill their duties or meet the requirements of their positions, the competent agencies and organizations may consider reassigning them to lower-level job positions or terminating their employment.
