Regarding the enforcement of maintenance fee handover at the Saigon Gateway project, the People’s Committee of Thu Duc City has sent an official letter to the Ho Chi Minh City Police and the Department of Natural Resources and Environment of 63 provinces and cities, requesting support in verifying the assets of Hiep Phu Land Company. This verification will provide a basis for enforcing the seizure and auction of the company’s assets according to regulations.
Once the verification results are available, the People’s Committee of Thu Duc City will proceed with the seizure and auction of the company’s assets.
On June 4th, the head of Task Force 5013 organized a meeting and agreed to resolve the issue of granting 933 pink books (including 904 apartments and 29 shophouses) at the Saigon Gateway Apartment Area project.

Concerning the handover of maintenance fees at Saigon Gateway Apartments, the Department of Construction proposed that the People’s Committee of Thu Duc City carry out the directions of the Chairman of the Ho Chi Minh City People’s Committee as stated in Document No. 4322. In case of any violation of the law, the case should be promptly transferred to the competent authorities for handling according to regulations.
At the same time, coordinate with the Department of Natural Resources and Environment to consider seizing the commercial service land with an area of 5,000.1 square meters as specified in the Certificate of Land Use Right, Ownership of Houses and Other Assets Attached to Land No. CT77766.
Regarding the granting of pink books for Saigon Gateway Apartments, the Department of Natural Resources and Environment is requested to urgently review the granting of certificates for the above-mentioned commercial service land with an area of 5,000.1 square meters, inform the residents of the results, and prevent gatherings and mass complaints that may disrupt security.
According to statistics, there are currently 413 projects in Ho Chi Minh City where the investors have handed over the maintenance fees to the management boards, and 163 projects where the investors have not yet done so.
In addition, there have been some complaints related to the management, operation, and use of apartment buildings. Specifically, investors have delayed the pink book granting process for residents, delayed or failed to hand over maintenance fees, or handed them over inappropriately; arbitrarily changed the function of items in the apartment building; disputes between the management board and investors regarding the ownership of common and private areas; and disputes over parking spaces within the apartment building.
Regarding disputes and complaints about apartment management and use, the Department of Construction proposed that the Department of Finance provide guidance on changing the “legal representative” of the enterprise in cases where the investor is arrested, serving a prison sentence, or deceased, to continue fulfilling the obligations and responsibilities of the investor. The Department of Justice is requested to guide the order, procedures, and authority in verifying and enforcing the seizure of house, land, or other assets of equivalent value, as well as the procedures for auctioning assets to recover maintenance fees for the management board.

The Construction Department inspected the premises, reviewed relevant documents, and reported their findings to the Ho Chi Minh City People’s Committee. They recommended an enforced transfer of maintenance fund management and suggested that any indication of criminal activity be referred to the police for further investigation.
