The Task Force 5013, chaired by the Director of the Department of Agriculture and Environment, Nguyen Toan Thang, convened to discuss and resolve issues pertaining to granting pink book ownership certificates for several apartment projects.
Specifically, the meeting focused on the Tin Phong apartment project in District 12, Ho Chi Minh City (known as 12 view apartment). The project, covering an area of 19,472 square meters, including nearly 10,000 square meters of residential land, comprises 408 apartments across 18 floors and is developed by Tin Phong Construction Trading Production Limited Company.

On April 2, 2009, the Ho Chi Minh City Department of Construction issued Decision No. 32, approving the investment project, which included the developer’s obligation to sell back 20% of the apartments to the city for resettlement purposes, as per Land Transfer Decision No. 5164.
However, during the construction and operation of the project, several violations and disputes arose between the developer and residents, as well as between the developer and the transferring unit, resulting in delays in granting pink book certificates and complaints from homebuyers. Legal proceedings were initiated by the involved parties.
In 2017, Hung Thinh Real Estate Business Investment Joint Stock Company acquired 387 apartments from Tin Phong Company and handed them over to customers. During the operation, Tin Phong Company filed a lawsuit against the Management Board, demanding the return of the parking basement for their management, operation, and exploitation. They also sued Hung Thinh Company, requesting the cancellation of the apartment sales contracts in the 12 view apartment project.
According to Hung Thinh Company, during the process of applying for pink book certificates for customers, it is necessary to conduct on-site measurements of the apartment project and obtain confirmation and seals from Tin Phong Company on the drawings as a basis for submitting the pink book application for homebuyers. However, Tin Phong Company has not handed over the necessary documents, hindering Hung Thinh Company’s ability to proceed with the pink book application process for their customers.
Mr. Nguyen Toan Thang concluded that, following this meeting, the developer must submit a written report to the Ho Chi Minh City Land Registration Office, clearly stating the issues raised during the meeting. For now, it is agreed to grant pink book certificates to homebuyers, and the developer must commit to resolving any outstanding issues, or else face sanctions.
During this working session, the Task Force 5013 also discussed and resolved issues related to five other housing projects, including the high-rise apartment in Tan Thoi Nhat Ward (District 12), An Phu Long 1 apartment (District 7), K26 apartment (Go Vap District), Phuong Viet apartment (District 8), and Him Lam residential area in Functional Area No. 7 (Binh Chanh District).

Regarding the An Phu Long 1 project, the developer, An Phu Long Real Estate Joint Stock Company, has fulfilled its financial obligations for the entire project. The State Construction Quality Inspection Bureau issued Notification No. 75 on the acceptance of the work for putting into use… The members agreed to grant pink book certificates for 168 residential apartments, while the officetel apartments will be considered for pink book issuance after the Ho Chi Minh City Department of Construction clarifies some related contents.
For the K26 apartment project, the Ho Chi Minh City People’s Committee issued a decision in 2004 to allocate land to Project 98 (Ministry of Defense) to invest in the construction of a housing area to serve the relocation and resettlement of military families within Tan Son Nhat Airport and military families living in barracks in Ho Chi Minh City.
Since 2009, the developer has handed over 640 apartments to residents, but pink book certificates have not been issued yet. Mr. Nguyen Toan Thang stated that they would continue to review certain aspects to resolve the issue and, if it exceeds their authority, report it to the Inter-sectoral Working Group of the Ho Chi Minh City People’s Committee and the Ministry of Defense for consideration and resolution.
