National Assembly Agrees to Extend Exemption of Agricultural Land Use Tax

According to the Resolution, households, individuals, and organizations directly engaged in agricultural production will be exempt from this land tax until the end of 2030, an extension of five years. This measure aims to ensure food security and enhance Vietnam’s competitiveness.

In cases where the state allocates land but the organization or individual does not use it directly and leases it to another unit for agricultural production, they must pay 100% of the agricultural land tax during the period before the state retrieves the land.

As per the government’s report, the total amount of agricultural land tax exempted or reduced averaged 3.268 trillion VND per year during the 2001-2010 period. This figure increased to 7.500 trillion VND annually in the last three years. Therefore, the exemption of agricultural land tax will encourage the concentration of land for large-scale production and promote the transformation of the agricultural and rural economy towards modernization.

In the explanatory report before the National Assembly’s vote, Mr. Phan Van Mai, Chairman of the Committee for Economic and Financial Affairs, stated that some opinions suggested not exempting tax for land left fallow or used for purposes other than agriculture. Other opinions recommended establishing criteria and conditions for tax exemption and sanctions for cases of policy abuse.

The National Assembly Standing Committee agreed with the deputies’ opinions, acknowledging the prevalent issue of land misuse and idleness, which leads to a waste of resources.

In addition to supporting farmers and rural areas, the National Assembly Standing Committee believes that the policy of exempting agricultural land use tax should also encourage organizations and individuals to use land efficiently. They suggested that there should be criteria to classify and identify eligible beneficiaries to ensure that support reaches the right recipients.

However, elaborating criteria to determine the beneficiaries of the tax exemption and prevent exemption for unused or misused land requires further research.

Moreover, the 2024 Land Law already includes provisions to help address the issue of abandoned agricultural land. Therefore, the National Assembly Standing Committee did not propose adding beneficiaries to the resolution but requested the Government to comprehensively evaluate the situation of agricultural land use and the effectiveness of the tax exemption policy.

“For now, the Government needs to provide full guidance on the Land Law provisions and take measures to prevent land idleness and resource waste,” said Mr. Mai.

The National Assembly Standing Committee also requested the Government to summarize and evaluate the exemption policy and propose mechanisms or amendments to the Law on Agricultural Land Use Tax to align with the new stage’s management requirements.
