
First, the People’s Committee at the communal level has the authority to grant land use certificates
According to Clause 1, Article 5 of Decree 151/2025/ND-CP, from July 1st, 2025, the Chairman of the communal-level People’s Committee will have the authority to grant land use certificates (red books) to domestic individuals, overseas Vietnamese with Vietnamese citizenship, and community residents.
In addition, the communal People’s Committee will also be delegated other authorities, including:
– Decision on approval of compensation, support, and resettlement plans
– Approval of the decision on land recovery and funding for enforcement activities
– Decision on specific land prices
– Decision on the sale price of resettlement housing within the locality.
Second, people can submit land registration dossiers at units in the same province
Previously, people could only submit land registration dossiers to the competent authorities where the land is located.
However, according to Clause 1, Article 18 of Decree 151, if submitting dossiers as specified in Clauses 3 and 4, Article 21 of Decree 101/2024/ND-CP (including dossiers for first-time land and asset registration; registration of land and asset changes), people can choose to submit them to any unit within the same province/city.
Third, no need for confirmation of compliance with planning, no disputes, and stable land use
According to Clause 4, Article 18 of Decree 151, when implementing the procedure for granting land use rights and ownership of assets attached to land, the communal People’s Committee does not need to separately confirm compliance with planning, no disputes, and stable land use.
Fourth, the procedure for first-time granting of land use certificates is shortened
According to Item II, Part A, Section V, Appendix I of Decree 151/2025/ND-CP, the time for carrying out the procedure for first-time granting of land use certificates includes: The time for first-time registration of land and assets is no more than 17 working days; The time for first-time granting of land use rights and ownership of assets is no more than 03 working days.
Previously, Clause 1, Article 22 of Decree 101/2024/ND-CP stipulated that the time for first-time land and asset registration could be up to 20 working days, and the time for granting certificates was no more than 03 working days.
Thus, the procedure for first-time granting of land use certificates can be shortened by up to 03 days.
