At a press briefing on socio-economic issues in Ho Chi Minh City on June 26th, Mr. Nguyen Kien Giang, Deputy Head of the Department of Construction Management and Transport Infrastructure, under the Ho Chi Minh City Department of Construction, announced that the pilot exemption from construction permits will facilitate and reduce administrative procedures and travel time for residents initiating construction projects in the city after the merger of provincial authorities.

According to Mr. Giang, the technical and legal requirements for exemption from construction permits are based on Article 89, Clause 2 of the 2014 Law on Construction for detached houses with a scale of less than seven floors belonging to investment projects in urban areas, housing construction projects with detailed planning of 1/500 that have been approved by competent state agencies.

The design and construction of detached houses are stipulated in Article 79, Clause 7 of the 2014 Law on Construction. The construction process for detached houses of households and individuals is specified in Clauses 3, 4, and 5, Article 9 of Government Decree 06/2021.

In response to Prime Ministerial Dispatch No. 78/2025 on focusing on cutting and simplifying administrative procedures in the construction sector, the Ho Chi Minh City Department of Construction has coordinated with Districts 6, 7, 8, 12, Binh Tan, Tan Phu, Can Gio, Hoc Mon, Nha Be, and Thu Duc City to review housing projects with detailed planning of 1/500 that have been approved.

On July 1st, the Department of Construction is expected to announce the projects with detailed planning of 1/500 or urban designs that have been approved by competent state agencies and are eligible for construction permit exemption.

The pilot exemption from construction permits will facilitate and reduce administrative procedures and travel time for residents.

Accordingly, the areas with the highest concentration of land plots exempt from construction permits are in District 7, Nha Be and Binh Chanh districts, and Thu Duc City.

In cases of exemption, residents are required to submit a construction commencement notification to the People’s Committee of the commune where the construction is located, at least seven working days before the commencement of construction. Mr. Giang noted that the notification must be accompanied by a certified copy of the legal land paperwork, and the design and construction of the detached house must comply with the specified architectural and planning criteria.

To monitor and supervise the construction process, Mr. Giang referred to Clause 3, Article 26 of the 2025 Law on Local Government Organization, which empowers the chairman of the ward-level People’s Committee to inspect compliance with the law in the construction of houses and urban construction works as prescribed by law.

Additionally, Clause 12, Article 7 of Circular No. 10/2025 of the Ministry of Construction, guiding the functions, tasks, and powers of specialized agencies under the People’s Committees of provinces and central-affiliated cities in the construction sector, stipulates the tasks and powers of the Department of Economic and Urban Infrastructure to inspect the construction of works according to the architectural management regulations, planning regulations, and urban designs approved by competent authorities, as well as to organize the public announcement of planning schemes.

Previously, Mr. Huynh Thanh Khiet, Deputy Director of the Ho Chi Minh City Department of Construction, shared that the department is currently focusing on reviewing and streamlining planning, with a priority on delegating permitting authority.

According to Mr. Khiet, the Government has issued Decree No. 140/2025/ND-CP, regulating the division of authority between two levels of local government in the field of state management under the Ministry of Construction.

The authority to grant construction permits for detached houses and Grade III and IV projects will be transferred from the district to the commune level People’s Committees.

Regarding the exemption from construction permits, Mr. Khiet stated that the Ho Chi Minh City Department of Construction is coordinating with the People’s Committees of districts, rural districts, and Thu Duc City to review and compile a list of areas that meet the conditions for exemption.

These are areas with detailed planning at a scale of 1/500 and meet all technical and legal requirements as prescribed. In such cases, residents do not need to obtain a construction permit but only need to notify the commencement of construction.

However, Mr. Khiet noted that the elimination of construction permit requirements also presents new management challenges. Functional units need to closely coordinate in supervising construction, handling disputes, and updating assets after the completion of the project.

According to a review, Ho Chi Minh City currently has about 360 areas with approximately 55,000 plots of land that meet the conditions for exemption from construction permits.

The Ho Chi Minh City Department of Construction is expediting the process of gathering feedback from local authorities on the list of areas eligible for exemption from construction permits, aiming to finalize it by July 1st for synthesis, reporting, and submission to the Ho Chi Minh City People’s Committee for consideration and decision.
