163 apartment buildings have not handed over maintenance funds
The Department of Construction has just reported to the People’s Committee of Ho Chi Minh City about complaints and lawsuits related to apartment buildings in the area. Accordingly, Ho Chi Minh City has 413 apartment buildings that have handed over maintenance funds, and 163 apartment buildings have not.
Of these, Thu Duc City has the most with 61 apartments, District 8 and District 10 each have 5 apartments, District 6 and Tan Phu District each have 8 apartments, Binh Thanh District has 7 apartments, and Binh Tan District has 6 apartments that have not handed over maintenance funds.
Regarding the disputes, complaints, and reflections that occurred in apartment buildings, the Ho Chi Minh City Department of Construction divided them into two groups.

Group 1 includes cases where the investor violated criminal law, was prosecuted and investigated; there is a document from a state agency requesting the public security agency to consider and handle the handover of maintenance funds; or the investor has died.
For this group, the Department of Construction proposed that the People’s Committee of Ho Chi Minh City assign the public security agency to soon have verification and handling results. The Department of Finance shall provide guidance on changing the legal representative of the enterprise in case the investor is arrested, serving a prison sentence, or has died to continue fulfilling the obligations and responsibilities of the investor.
Meanwhile, the Department of Justice shall provide guidance on the order, procedures, and competence in verifying and coercing the auction of apartment areas, land, or other assets of equivalent value; and the procedure for auctioning to recover maintenance funds.
Group 2 includes complaints, disputes, and reflections related to the management, operation, and use of apartment buildings, such as delays in granting certificates to residents; delays or failure to hand over maintenance funds for the common property of the apartment building; and the management, use, and handover of maintenance funds for the common property not in accordance with regulations.
According to the Ho Chi Minh City Department of Construction, the reason for the emergence of these disputes, complaints, and reflections is that some investors are slow or fail to organize the first apartment conference to elect the Management Board; the conference was organized, but the number of owners and apartment users attending was not enough as prescribed, and there was no written request for the commune-level People’s Committee to organize, or the apartment conference was held but no one nominated or nominated for the Management Board.
Another reason is the failure to hand over the complete apartment dossier and the maintenance funds for the common property of the apartment building to the Management Board, causing difficulties in checking, maintaining, and maintaining the work.
When disputes and complaints arise in the management and use of apartment buildings, they are resolved by the investor, the Management Board of the apartment building, the management and operation unit, and the owners in a less positive direction, leading to prolonged disputes and complaints, sending complaints to many places and levels.

Considering the auction of 5,000 m2 of land
Regarding the handling of the proposal of Saigon Gateway apartment residents (Thu Duc City), the Ho Chi Minh City Department of Construction said that the People’s Committee of Ho Chi Minh City has Document No. 4322/VP-DT, requesting the Chairman of Thu Duc City People’s Committee to urgently inspect and forcefully hand over the maintenance funds for the project according to its competence and in accordance with the law. In addition, the People’s Committee of Thu Duc City has written to the Ho Chi Minh City Police, the Department of Agriculture and Environment of 63 provinces and cities to support the verification of assets of Hiep Phu Land Company as a basis for coercing the auction of assets according to Clause 91, Article 95 of the Government’s Decree No. 95/2024/ND-CP dated July 24, 2024. After the asset verification results are available, the People’s Committee of Thu Duc City will have a basis to proceed with the auction of assets according to regulations.
The Department of Construction proposed that the People’s Committee of Ho Chi Minh City assign the People’s Committee of Thu Duc City to coordinate with the Department of Agriculture and Environment to consider auctioning the commercial service land area of 5,000 m2 according to the certificate of ownership No. CT77766 granted to Hiep Phu Land Company in 2019.
Regarding the direction of the People’s Committee of Ho Chi Minh City for the Department of Agriculture and Environment to resolve the granting of pink books to residents of Saigon Gateway apartment building, the Department has organized a meeting and agreed to resolve the granting of 933 pink books to residents.
Earlier, on June 13, the People’s Committee of Ho Chi Minh City directed the People’s Committee of Thu Duc City and the Department of Agriculture and Environment to urgently force the handover of maintenance funds and grant pink books to residents of Saigon Gateway apartment building, reporting the results to the Chairman of the People’s Committee of Ho Chi Minh City.
