Dong Nai Provincial People’s Committee has issued an administrative sanction decision against Mango Garden Eco-tourism Company for serious violations in the field of land and environment. The total fine amounts to VND 1.55 billion, and the company is also required to refund illegal profits of over VND 154 billion.

This decision is based on the Law on Handling Administrative Violations, the 2024 Land Law, Decree No. 123/2024/ND-CP on sanctions in the field of land, and Decree No. 45/2022/ND-CP in the field of the environment.

According to the decision, Mango Garden Eco-tourism Company, located in Phuoc Tan Ward, Bien Hoa City, and directed by Mr. Ngo Van Sang, committed five administrative violations.

Specifically, the enterprise illegally converted tens of hectares of agricultural land and production forest land for non-agricultural purposes to serve commercial and service purposes without authorization from competent authorities. The total area of violation includes:

– 2.94 hectares of rice land

– 0.47 hectares of production forest land

– 30 hectares of land for annual and perennial crops

– 1.24 hectares of public land (stream) managed by the state

In addition, the eco-tourism site operated without an environmental permit, although it was mandatory to obtain one issued by the Dong Nai Provincial People’s Committee.

Based on the current regulations, the Dong Nai Provincial People’s Committee imposed a fine totaling VND 1.55 billion, divided according to each violation. At the same time, the company is subject to remedial measures, including:

– Refunding illegal profits of VND 154.19 billion, determined from the difference in land use value for the wrong purpose according to the current land price framework.

– Restoring the original state of the land before the violation by the end of 2026.

– Suspending the operation of waste sources for 3.75 months due to the lack of an environmental permit.

According to the sanction decision, Mango Garden Eco-tourism Company is responsible for fulfilling all obligations within ten days from the receipt of the decision and reporting the results to the Department of Agriculture and Environment and the Department of Finance of Dong Nai province.

In case of non-compliance, the competent authorities will enforce the decision according to the law. Simultaneously, the company’s violation information will be publicly announced on the Dong Nai Provincial Portal.
