On March 13, the leaders of the Office of the People’s Committee of Khanh Hoa province announced that Vice Chairman of the provincial People’s Committee, Tran Hoa Nam, has signed Decision No. 02/2024/QD-UBND regarding amendments and supplements to the regulations on conditions for dividing land plots.
According to a previous decision issued by the Khanh Hoa People’s Committee (No. 28/2022/QD-UBND dated December 27, 2022), there are regulations on the minimum area for dividing land plots for each type of land. Specifically, point d, clause 1, article 10 of the aforementioned decision specifies that “in case a part of a land plot is divided for the purpose of converting agricultural land to residential land, the divided area for the conversion to residential land and the remaining area of agricultural land must meet the minimum size and area requirements for dividing land plots according to point a, clause 1, and clause 2 of this article.”
The aforementioned provision also includes the additional requirement that “at the same time, the conversion of land use must meet the technical infrastructure conditions of the area, be consistent with land use planning, annual district-level land use plans; urban zoning plans or detailed urban plans (if available), detailed plans for building residential points in rural areas approved by competent state authorities.”
However, Decision No. 02/2024/QD-UBND of the Khanh Hoa Provincial People’s Committee has amended and abolished the entire content of the provision “at the same time…” in point d, clause 1, article 10 mentioned above.
In this new decision, the Khanh Hoa Provincial People’s Committee also removed the provision that the district-level People’s Committee “based on the actual situation and specific conditions of the locality, issues regulations on the basic conditions for technical infrastructure to be met when allowing land use conversion and land plot division” (point b, clause 4, article 12 of Decision No. 28/2022/QD-UBND).
