On April 26, Mr. Bui Tu Hai, Vice Chairman of the People’s Committee of Ca Mau City (Ca Mau province) confirmed that the house of Mr. Ho An Tap – the owner of the “most beautiful building in Ca Mau” livestream villa – has not yet completed the procedures for changing the purpose of land use (aquaculture land to residential land) according to the revised decision, supplementing a part of the city’s administrative penalty decision on November 15, 2023.
Specifically, the revised and supplemented decision states: “Force to maintain the status quo of land use as at the time of discovery of the violation and must carry out the procedures for land in accordance with the regulations within 30 days (working days) for the area of 2,261.58m2”.
If the procedures for land are not carried out in accordance with the regulations, the city will apply point a, clause 4, Article 11 of Decree No. 91/2019/ND-CP of the Government dated November 19, 2019, which regulates administrative penalties for land violations, forcing the restoration of the original state of the land before the violation.
Explaining why Mr. Tap has not yet completed the conversion of land use for more than 5 months, the Vice Chairman of the People’s Committee of Ca Mau City said: “Mr. Tap has submitted the procedures but is in the process of recalculating taxes…”.
Previously, as Tien Phong reported, the facebook account Ho Tap continuously posted images and livestreamed the construction process of a building described as “the most beautiful in Ca Mau province”.
After inspection, the authorities concluded that this project was in violation of building on aquaculture land. Both of these plots of land did not meet the conditions for converting the purpose of use from aquaculture land to residential land in rural areas, as they did not comply with the construction planning.
Therefore, on January 9, 2023, the Chairman of the City People’s Committee issued Decision No. 82/QD- XPHC on administrative penalty for Mr. Tap. The fine was 22.5 million VND, and the remedial measure was to restore the original state of the land before the violation.
However, after comparing the regulations, the City People’s Committee concluded that in the case of the location of Mr. Tap’s land, the construction project must complete the procedures for changing the purpose of land use in accordance with the regulations. The Chairman of the city People’s Committee has issued a decision to amend and supplement a part of the decision on administrative penalty.
