On September 10, the Office of the People’s Committee of Binh Thuan Province sent a document to the Department of Home Affairs and the People’s Committee of Phan Thiet City regarding the handling of information about a cluster of restaurants, cafes, and dozens of villas built illegally on a plot of land spanning over 4,500 square meters, most of which is state-managed land, at Doc Hoang Hon in Phan Thiet City.

Accordingly, the Chairman of the Provincial People’s Committee of Binh Thuan directed the People’s Committee of Phan Thiet City to urgently organize an inspection and strictly handle the situation of land occupation and illegal construction in accordance with the law.

At the same time, the Chairman also instructed the strict punishment of the Chairman of the People’s Committee of Phu Hai Ward and related individuals and organizations in the ward, in accordance with Directive No. 08/CT-UBND dated July 20, 2020, on strengthening inspection of planning management and construction order in Binh Thuan Province, and Directive No. 08/CT-UBND dated October 3, 2023, on strengthening land management in the province.

The Chairman of Binh Thuan Provincial People’s Committee also requested an inspection of the responsibility of the Chairman of Phan Thiet City People’s Committee and related agencies and units for the above situation. Additionally, the Chairman of Binh Thuan Provincial People’s Committee assigned the Department of Home Affairs to monitor the inspection of organizations and individuals and report the results to the Provincial People’s Committee within the specified timeframe.

Currently, at the end of Nguyen Xuan Thuy Street (Ward 5, Phu Hai Ward, also known as Doc Hoang Hon), Cafe Doc Hoang Hon is a grand complex of constructions, including a restaurant, cafe, parking lot, and dozens of separate villas built over a year ago to serve tourists.

This complex of constructions is owned by Mr. N.N.P. (38 years old, residing in Ham Thang Commune, Ham Thuan Bac District, Binh Thuan Province). In mid-2023, Mr. P. started constructing these unauthorized buildings on a plot of land spanning over 4,500 square meters.

Out of the total area of over 4,500 square meters, Mr. P. was only granted a small plot of agricultural land in the coastal area. The rest of the land was encroached upon and belonged to the state’s unmanaged land.

In July 2023, the People’s Committee of Phan Thiet City issued a decision to fine Mr. P. VND 20 million for the act of occupying state-managed land in urban areas and constructing structures without permission from authorized state agencies.

The People’s Committee of Phan Thiet City also forced Mr. P. to refund the illegal profits gained from the administrative violation, amounting to over VND 63 million. Additionally, they ordered him to restore the land to its original state before the violation and return the occupied state-managed land.

However, more than a year after the decision was issued by the People’s Committee of Phan Thiet City, Mr. P. did not comply with the demolition order but instead expanded and completed the unauthorized constructions to put them into operation.
