On September 13, an inter-sectoral inspection team from Phan Thiet City, Binh Thuan Province, met with Mr. N.N.P. (born 1985, residing in Ham Thang, Ham Thuan Bac) regarding the coordination of handling unlicensed constructions at Hoang Hon slope (Ward 5, Phu Hai Ward).
At the meeting, Mr. P. admitted that the construction of unlicensed structures at the Hoang Hon slope cafe was wrong. However, Mr. P. stated that he did not initiate the construction but that his brother, Mr. N.N.Ph. (born 1974), did.
Mr. N.N.P. stated that he had agreed with Mr. Ph. to request the competent authorities for a two-month deadline to dismantle the illegally built structures.
However, the inter-sectoral team from Phan Thiet City did not agree with this proposed timeline. “The Inspection Team does not agree with this condition regarding the timeframe. We request that the structures be dismantled within 10 days from today… At the site, the dismantling process is underway,” said Mr. Vo Van Phuc, Head of the City’s Natural Resources and Environment Office.
At the meeting, Mr. N.N.P. requested a reconsideration of the legality of the 4,544.3 sq. m land on which the structures were built. According to Mr. P., he had agreed to purchase this land from the local residents and had made payments, so the land’s legality should be considered during the handling process.
On this matter, the inter-sectoral inspection team stated that they would coordinate with Phu Hai Ward to investigate the land’s origin and history before resolving the proposal.
According to the inter-sectoral team from Phan Thiet City, in addition to the dismantling process, they will also re-evaluate the procedure to impose penalties on Mr. N.N.P. for his unauthorized construction at the Hoang Hon slope.
Previously, in July 2023, when the unauthorized construction by Mr. N.N.P. at this site was first discovered, the People’s Committee of Phan Thiet City had issued a decision to fine him VND 20 million for occupying unused land managed by the state in urban areas and constructing structures without permission from competent state authorities.
Phan Thiet City also forced Mr. P. to refund the illegal profits obtained from the administrative violation, amounting to over VND 63 million.
Additionally, they required him to restore the land to its original state before the violation and return the occupied land, which is managed by the state.
However, Mr. P. did not comply with the penalty decisions and continued to complete the construction of the structures.
