The Ho Chi Minh City Peopleโs Committee has recently authorized the Department of Construction to receive and process applications for project transfers and certain procedures related to real estate business.
Regarding the procedure for transferring a part or the whole of a project, the Department of Construction will be the agency receiving the transfer request from the investor. Subsequently, they will seek opinions from relevant departments and local authorities where the project is located.

Based on the feedback received, the Department of Construction will evaluate the application. If the conditions are not met, they will issue a rejection letter, clearly stating the reasons to the investor. In case the conditions are met, the Department of Construction will submit the proposal to the Ho Chi Minh City Peopleโs Committee for consideration and decision.
Thus, the Department of Construction will handle most of the steps in the approval process for transferring a part or the whole of a real estate project.
According to the 2023 Law on Real Estate Business, the authority responsible for receiving applications for transferring a part or the whole of a project is the Provincial Peopleโs Committee or the state management agency for real estate business at the provincial level, as authorized by the Provincial Peopleโs Committee.
Regarding procedures such as selling or leasing future homes or granting licenses for real estate trading floors, the Ho Chi Minh City Peopleโs Committee has authorized the Department of Construction to handle all steps from receiving and inspecting applications to approval.
In terms of publishing information about enterprises providing brokerage, consulting, and real estate management services on the information system for housing and the market as prescribed, the Ho Chi Minh City Peopleโs Committee has also authorized the Department of Construction to provide guidance and implementation.
