The Government Inspectorate has just issued a conclusion on the inspection of the responsibility for performing public duties of officials, public employees, and civil servants in handling Administrative Procedures (AP), and providing public services to citizens and enterprises at the People’s Committee of Da Nang city. The inspection period was from June 15, 2021, to November 30, 2023.
Alongside the achievements, the Government Inspectorate pointed out some limitations and violations. Specifically, the Inspectorate stated that the People’s Committee of Da Nang City advised and presented to the City Council to issue a resolution regulating policies containing administrative procedures, but the content was not comprehensive enough as stipulated in Decree No. 63/2010/ND-CP.
Furthermore, the People’s Committee has not issued and publicized modified and supplemented administrative procedures for two procedures according to the City Council’s resolutions. There has also been a delay in implementing the decentralization plan for handling administrative procedures (2022-2023) in several fields, with a low achievement rate compared to the plan approved by the Prime Minister.
The Chairman of the Da Nang City People’s Committee has not yet approved the internal process for handling 976 administrative procedures under its authority, nor has it established an electronic procedure for handling administrative procedures in the software of the City People’s Committee’s one-door information system.
According to the Inspectorate, the inspection and supervision of administrative procedure resolution in this locality have not been regularly conducted, and the results have been limited. The existing shortcomings and mistakes have not been promptly rectified and addressed.
During the inspection, the Government Inspectorate discovered 13 administrative procedures advised by the Departments of Natural Resources and Environment, Planning and Investment, and Construction, appraised by the Office of the Da Nang City People’s Committee, and issued by the Chairman of the Da Nang City People’s Committee, which had some violations.
The overdue administrative procedure resolution dossiers mainly belong to the fields of investment, land, construction, and planning, related to investment projects. The Government Inspectorate has also identified some shortcomings and weaknesses in the process, which are the responsibility of the leaders of the Da Nang City People’s Committee, the Office of the People’s Committee, and a number of sectors and departments.
To address these shortcomings, the Government Inspectorate recommends that the Prime Minister direct the People’s Committee of Da Nang City to review and promulgate or propose amendments and supplements to overcome certain shortcomings and inadequacies in the legal regulations on the order of implementation, dossier content, time, and conditions for handling administrative procedures.
Additionally, the Government Inspectorate recommends that the Prime Minister assign the Government Office to coordinate with relevant ministries and sectors to review the regulations on the order of implementation, dossier content, time, requirements, and conditions for handling administrative procedures stipulated in Decree No. 61 and Decree No. 63.
At the same time, the Government Office shall issue or propose amendments and supplements to overcome certain shortcomings and inadequacies, such as regulations on requesting additional dossiers, returning dossiers for supplementation, returning dossiers for refusal of handling, and obtaining opinions from relevant agencies, as well as calculating the time for handling dossiers during the consultation period.
The People’s Committee of Da Nang City shall implement self-criticism for the leaders and those directly involved regarding the shortcomings and mistakes in state management and administrative procedure resolution and public service provision for citizens and enterprises as mentioned in the inspection conclusion.
Within its authority, the Chairman of the Da Nang City People’s Committee shall direct the leaders of departments, sectors, units, and individuals involved to undergo self-criticism.
