On December 17, Ho Chi Minh City Police announced that they had completed the investigation and transferred the entire file to the People’s Procuracy of the same level, proposing to prosecute Mr. Pham Phuong (DOB 1971) and Dinh Viet Cuong (DOB 1974) for “Embezzlement of Assets” and “Abuse of Position and Power while performing official duties.”
In relation to the case, Mr. Phan Duong Dai (Director of Dai Tien Import-Export Co., Ltd.) and two others were recommended for prosecution for “Embezzlement of Assets.”
Ton Ngoc Bach (DOB 1954) and Nguyen Thi Dao (DOB 1967) were also proposed to be prosecuted for “Abuse of Position and Power while performing official duties.”
These individuals were formerly members of the Management Board of Mieu Noi Apartment Building (in Binh Thanh District, Ho Chi Minh City) and caused a loss of VND 3.3 billion, of which the investigating agency found that they had embezzled VND 2.5 billion.
Mr. Pham Phuong was the head of the Management Board of Mieu Noi Apartment Building, while Mr. Cuong and Ms. Dao were deputy heads, and Ms. Bach was a member. These individuals failed to comply with legal regulations regarding the management of the apartment building, and instead of hiring a specialized management and operation unit, they self-managed and carried out repairs and installations of various items in the building, causing a loss of more than VND 3.3 billion for the residents.
According to the case details, Mr. Phuong discussed with Mr. Dai the installation of two elevators for Block B and two elevators for Block C at a low price but inflated the value of the elevators in the contract to appropriate the inflated amount.
Each elevator only purchased three main components, including a traction machine, an electrical cabinet, and a load-bearing cable from a foreign manufacturer. The remaining components were either purchased as raw materials for processing or outsourced to another company for processing.
Mr. Dai quoted a price of VND 800 million per elevator for Block B with a load capacity of 1,600 kg and VND 700 million per elevator for Block C with a load capacity of 1,000 kg.
Mr. Phuong informed Mr. Dai to inflate the price of the left elevator in Block B to VND 1.035 billion and the right elevator in Block B and the two elevators in Block C by VND 200 million each.
At the same time, Mr. Phuong discussed the matter with Mr. Cuong beforehand to gain his agreement to share the benefits. As a result, Mr. Dai embezzled VND 500 million, Mr. Phuong VND 235 million, and Mr. Cuong VND 100 million.
Additionally, during his tenure as the head of the apartment management board, Mr. Phuong hired a construction unit to repair the internal road despite repeated warnings and notices from competent authorities to maintain the original design. The Inspectorate of the Department of Construction later issued an administrative penalty decision with a fine of VND 15 million.
