An Giang police have recently concluded their investigation into a case of “Violation of regulations on research, exploration, and exploitation of natural resources; Bribery; Abuse of Power; Illegal printing, issuance, and trading of invoices and budget contribution receipts; and Money Laundering” involving Trung Hau 68 JSC, the Department of Natural Resources and Environment of An Giang province, and related units.

The investigation agency has proposed prosecuting 44 defendants. Among them, Le Quang Binh, Chairman and General Director of Trung Hau 68 JSC, is accused of three charges: Bribery, Violation of regulations on natural resource exploration and exploitation, and Money Laundering.

Tran Anh Thu, former Vice Chairman of the An Giang provincial People’s Committee, and Nguyen Viet Tri, former Director of the Department of Natural Resources and Environment of An Giang province, are proposed to be prosecuted for Bribery.

According to the investigation’s conclusions, in his role as Chairman and General Director of Trung Hau 68 JSC, Le Quang Binh allowed the company to obtain permits for exploring and exploiting sand and increasing its exploitation capacity contrary to legal regulations. He also overlooked violations during the sand mining process in My Hiep and Binh Phuoc Xuan communes, Cho Moi district, An Giang province.

Binh directly and through his relatives and subordinates, bribed Tran Anh Thu with over VND 961 million and Nguyen Viet Tri with VND 2.3 billion and USD 30,000 (equivalent to over VND 3.1 billion). Le Quang Binh’s actions constitute the offense of Bribery of more than VND 4 billion.

Meanwhile, in his role as Vice Chairman of the An Giang provincial People’s Committee, in charge of natural resources and the environment, Tran Anh Thu received more than VND 961 million from Trung Hau 68 JSC. In return, he instructed Nguyen Viet Tri, then-Director of the Department of Natural Resources and Environment, to facilitate the company’s sand exploitation by not requiring them to return the mine to the provincial People’s Committee. He also allowed adjustments to the exploitation capacity to supply sand for the National Highway 91 connection project and the Long Xuyen bypass project, even though the company did not meet the criteria regarding contracts with construction contractors and the criteria set by the provincial People’s Committee.

Despite knowing that the mine’s depth had exceeded the permitted level, Thu still signed a decision to increase the exploitation volume for Trung Hau 68 JSC. His actions resulted in the company illegally exploiting more than 3,710 cubic meters of sand, causing a loss of more than VND 293 billion to the state property.

Regarding Nguyen Thanh Binh, as the Chairman of the An Giang provincial People’s Committee, he was responsible for the overall direction of the committee’s activities. However, at the request of the Chairman of Trung Hau 68 JSC, he instructed Thu and Tri to facilitate the company in obtaining a permit for surveying and exploring the sand mine through direct designation without going through an auction.

Nguyen Thanh Binh also instructed Thu to sign a mineral exploitation license for Trung Hau 68 JSC to supply sand for the My Thuan – Can Tho Expressway project, which was not in line with the project’s original objectives. He allowed the company to exploit sand without returning the mine to the provincial People’s Committee and permitted adjustments to the exploitation capacity for the National Highway 91 connection and Long Xuyen bypass projects, despite the company not meeting the required criteria.

Nguyen Thanh Binh also instructed Thu and Tri to facilitate an increase in the company’s exploitation capacity, even though he was aware that the riverbed depth in the sand mine area had exceeded the permitted level.

For his part, Nguyen Thanh Binh received USD 300,000 as a token of gratitude from Le Quang Binh.
