![]() Urgent issuance of guiding documents for the Law on Land, Law on Real Estate Business; promoting the implementation of social housing projects

This is the content of the Prime Minister’s Official Dispatch No. 130/CD-TTg, dated December 10, 2024, on urging the direction, timely removal of difficulties and obstacles to promote the implementation of social housing projects.
Facilitating social housing investment for enterprises and access to social housing for eligible individuals
To ensure the realization of the goal of developing social housing as directed in Directive No. 34-CT/TW of the Secretariat, the Prime Minister requests Ministers, heads of ministerial agencies, Government agencies, Secretaries of Provincial Party Committees, Chairpersons of the People’s Committees of provinces and centrally-run cities to continue to focus on leading, directing and drastically and effectively implementing the tasks and solutions mentioned in Resolution No. 33/NQ-CP dated March 11, 2023, and the resolutions of the Government and the Prime Minister’s directives.
Urgently establish a plan to effectively implement the tasks and solutions assigned in Directive No. 34-CT/TW of the Secretariat and Decision No. 927/QD-TTg dated September 30, 2024, of the Prime Minister approving the Plan to implement Directive No. 34-CT/TW of the Secretariat, completing it in 2024.
Continue to effectively implement key solutions and tasks to promote decentralization, delegation of power, reform, and maximum reduction of administrative procedures to facilitate enterprises’ participation in social housing investment and access to social housing for eligible individuals.
Streamline administrative procedures related to land allocation, site clearance, investment, and construction, as well as the selection of investors for social housing projects, ensuring speed, convenience, publicity, and transparency.
In 2024: Complete the issuance and amendment of documents related to the Law on Land, Housing, and Real Estate Business
Chairpersons of the People’s Committees of provinces and centrally-run cities shall urgently issue, within their competence, or submit to the Provincial People’s Councils for issuance of documents stipulating a number of contents assigned in the Law on Land and the Law on Real Estate Business; review documents for amendment, supplementation, replacement, or new issuance to ensure compliance with the provisions of the Law on Land, Housing, and Real Estate Business. Complete this task by the end of 2024.
Regarding the planning and allocation of land funds for social housing and worker housing: Review and supplement urban planning and industrial park planning to ensure the allocation of sufficient land funds for social housing, including worker dormitories and housing for the armed forces.
Strictly adhere to the regulations on allocating land funds for worker dormitories in industrial parks and allocating 20% of land funds with technical infrastructure in commercial housing projects and urban areas for social housing development in accordance with the law on housing.
Incorporate social housing development indicators into the socio-economic development indicators
Regarding the investment in the construction of social housing projects: Focus on implementing the Scheme “Investing in the construction of at least 1 million social houses for low-income people and industrial park workers in the period of 2021-2030”; complete the assigned social housing construction targets for 2024.
Incorporate social housing development indicators into the 5-year and annual socio-economic development indicators.
Proactively allocate funds for site clearance and organize site clearance to obtain clean land funds for social housing.
Organize auctions and bidding to select investors with strong financial capacity and experience, ensuring transparency.
For projects that have started construction, regularly inspect and supervise to ensure their early completion, acceptance, and timely operation.
For projects that have been approved in principle for investment, urgently carry out procedures for investor selection, land allocation, land use right certificates, design basis and technical design appraisal, construction permits, etc., to start construction as soon as possible.
For land funds for social housing projects that have not yet been approved in principle for investment, urgently establish planning, appraise pre-feasibility reports, update projects into local programs and plans, etc., to complete the procedures for approval in principle for investment and selection of investors to implement the projects.
Publish the list of social housing projects on the Provincial People’s Committee’s website
Regarding preferential capital sources for social housing development: Continue to examine and inspect legal procedures, establish a list of projects for the construction of social housing, worker housing, and renovation and construction of apartment buildings eligible for loans from the VND 120,000 billion credit package, and publish it on the provincial People’s Committee’s portal so that banks have a basis for lending according to the program and send documents to the State Bank of Vietnam and the Ministry of Construction for monitoring and synthesis.
Balance and allocate local budget capital to entrust the Social Policy Bank to lend for buying, renting, and purchasing social housing, and for construction, renovation, and repair of houses.
Strengthen training, propaganda, and dissemination of the contents of the Law on Land, Housing, and Real Estate Business
The Prime Minister requests the Minister of Construction to strengthen training, propaganda, and dissemination of the contents of the Law on Housing, the Law on Real Estate Business, and the guiding documents detailing these laws.
Urge localities to review, supplement planning, and allocate land funds for social housing development in urban areas and worker housing in accordance with the law; strictly implement the regulation on allocating 20% of land for social housing in housing and urban area projects and ensure the demand for social housing development in the locality.
Strengthen inspection, examination, and handling of violations in the implementation of the law on social housing development.
The Minister of Natural Resources and Environment shall strengthen training, propaganda, and dissemination of the contents of the Land Law and guiding documents detailing this Law.
Coordinate with the Ministry of Construction to guide localities in planning, land use planning, and ensuring land funds to implement projects to build social housing and worker housing.
The Governor of the State Bank of Vietnam shall coordinate with relevant ministries and sectors to strongly promote the disbursement of the VND 120,000 billion credit program for lending to social housing and worker housing.
The Prime Minister assigns Deputy Prime Minister Tran Hong Ha to directly inspect, urge, and resolve within his competence and report to the Prime Minister on issues beyond his competence.
The Government Office shall inspect the ministries, agencies, and localities in the performance of the tasks assigned in this Official Dispatch.
