At the 8th Session, the Government submitted to the National Assembly for comments on the draft Law on State Capital Management and Investment in Enterprises, replacing Law No. 69/2024/QH13.
After listening to the report by the Ministry of Finance and the opinions of ministries, sectors, and enterprises at the meeting on the draft Law on State Capital Management and Investment in Enterprises, in the afternoon of February 7, Deputy Prime Minister Ho Duc Phoc emphasized that the new Law must inherit the good contents of Law No. 69/2024/QH13 and, at the same time, remove bottlenecks in reality.
On that basis, Deputy Prime Minister Ho Duc Phoc gave specific opinions on the contents related to the competence of state capital management by subjects, especially the delegation and decentralization in deciding the strategy, plan for investment in production and business; deciding on personnel; salary and bonus mechanism; development investment fund…
The Deputy Prime Minister clarified that in terms of managing state capital, it is necessary to comply with the principle: “Where there is state capital, there must be management. The issue is to design an appropriate and effective management mechanism”.
Especially, the new law must remove difficulties, obstacles, and bottlenecks in the practical activities of enterprises. The law must be as comprehensive as possible, leaving no legal vacuum, and avoiding situations where there are situations in reality but no legal regulations.
Emphasizing the government’s spirit of promoting decentralization and empowerment to enterprises to be autonomous and flexible and improve their production and business capacity, but must be controlled, Deputy Prime Minister Ho Duc Phoc requested that the drafting board maximize the opinions of the agencies and enterprises and complete the draft Law to submit to the Government before February 13.
