During the discussion on the draft Law on Officials and Civil Servants (amended), Minister of Home Affairs Pham Thi Thanh Tra shared that this draft law is designed to facilitate a “流動政策”, aiming to completely eradicate the lifelong tenure mechanism.

According to the Minister, the law amendment presents an opportunity to transform the mindset and philosophy behind civil service organization. In this regard, job positions are considered the central element, acting as the “common thread” in recruitment, employment, management, training, reward, and discipline of officials and civil servants.

The Minister affirmed that the draft retains the rank of civil servants in job positions. This technical tool is essential for determining the hierarchy within the civil service system. “We maintain the rank structure to implement and realize salary reform. Eliminating the rank of civil servants would complicate the design of related mechanisms and policies,” said Ms. Tra.

To abolish the lifelong tenure mechanism, the Minister suggested employing two tools simultaneously: performance evaluation based on job positions and the application of contract mechanisms. Contracts can be utilized for experts, scientists, and individuals occupying specific job positions, aligning with modern public administration trends worldwide.

“A separate decree on evaluation, including KPIs and data for assessment, will be issued soon. We will measure performance based on work output rather than vague qualitative criteria,” added the head of the Ministry of Home Affairs.
