On May 13th, the Ninh Thuan Provincial Inspectorate announced the findings of their inspection into the management of investment, construction, land, and environmental protection at the Ho Ba Be Tourist Resort project in Phuoc Dinh commune, Thuan Nam district, Ninh Thuan province.

In 2009, the Ninh Thuan People’s Committee granted an investment certificate to Son Hai Joint Stock Company (Son Hai JSC) for the Ho Ba Be Tourist Resort project, spanning 20 hectares. The project aimed to develop a tourism and resort area featuring a range of villas, hotels, restaurants, swimming pools, and more.

From 2009 to 2014, after receiving the investment certificate, the investor did not immediately initiate land and other procedures to implement the project. Instead, they requested an increase in the project’s scale and area, which was not approved by the Ninh Thuan People’s Committee.

In 2011, after the state leased 3.79 hectares of the 20-hectare project land to Son Hai JSC, the company still failed to develop a detailed construction plan for the entire project and did not commence construction.

During this period, Mr. Tran Tuan Viet, Chairman of Son Hai JSC’s Board of Directors, independently contacted and agreed to purchase land from local residents, amounting to over 10 hectares outside the project boundary. Subsequently, the company proceeded to invest in and construct a project named “Mongol Village Tanyoli” on this land without establishing the necessary procedures related to land and construction. This act violated regulations regarding conditions for receiving land use right transfers, capital contributions, or land rentals for agricultural production projects, business, and non-agricultural production.

Notably, in 2014, 2015, and 2016, Son Hai JSC submitted numerous reports to the authorities of Ninh Thuan province, containing inaccurate information. These reports claimed that 80% of the project’s construction had been completed. However, in reality, the company had carried out unauthorized construction at the Mongol Village Tanyoli project. Meanwhile, on the land leased from the state, Son Hai JSC had not constructed any items.

From 2015 to 2018, the misleading and inaccurate reports from Son Hai JSC led to unclear project implementation reports from the Department of Planning and Investment (before the merger) of Ninh Thuan province. As a result, the Ninh Thuan People’s Committee decided to approve adjustments to the project twice (the third and fourth times). After the fourth adjustment, the project’s scale and area doubled from 20 hectares to 47.7 hectares, incorporating the illegally constructed area at the foot of the mountain (Mongol Village Tanyoli) into the project’s scope.

According to the Ninh Thuan Provincial Inspectorate, 15 years have passed, and due to the large scale of the project, the investor’s lack of experience and financial capacity, the project has not been completed as committed. Currently, the project has not finalized land and construction procedures to meet the conditions for commencement. Meanwhile, the Mongol Village Tanyoli has seen the construction of numerous structures, including tents, wooden bungalows, and restaurants, which are operating without completing the necessary legal procedures related to land and construction.

Given the aforementioned violations, the relevant authorities of Ninh Thuan province have proposed that the People’s Committee terminate the entire Ho Ba Be Tourist Resort investment policy, including the Mongol Village Tanyoli project of Son Hai JSC, and retrieve the 3.9 hectares of land leased to the company for this project.

The Provincial People’s Committee has also requested that relevant departments and localities urgently organize a review of responsibilities regarding the shortcomings in advising and coordinating the implementation of assigned tasks during the project’s deployment.
