The suspension, termination, and continuation of monthly social insurance benefits are detailed in Article 75 of the 2024 Social Insurance Law.
Specifically, there are three cases in which a person currently receiving monthly social insurance benefits will have their benefits temporarily suspended: illegal exit from the country; declared missing by a court; or failure to verify the recipient’s information.
From July 1st, people currently receiving monthly social insurance benefits will have their benefits temporarily suspended in three cases. Illustrative image.
According to Point c, Clause 2, Article 11 of the 2024 Social Insurance Law, beneficiaries of social insurance regimes who receive benefits through personal bank accounts are responsible for annually coordinating with the social insurance agency or the service organization authorized by the social insurance agency to verify their eligibility for social insurance regimes.
If the beneficiary does not coordinate with the social insurance agency to verify their information, and their information cannot be verified, their social insurance benefits will be temporarily suspended. This is a change from the current Social Insurance Law.
Additionally, Article 75 of the 2024 Social Insurance Law stipulates three cases in which the enjoyment of monthly social insurance benefits will be terminated.
First, if the beneficiary dies or is declared dead by a court.
Second, if the beneficiary refuses the benefits in writing.
Third, if a competent authority concludes that the beneficiary has been receiving social insurance benefits contrary to legal regulations.
Also, according to Article 75 of the 2024 Social Insurance Law, individuals whose benefits have been temporarily suspended or terminated may be able to resume receiving benefits in certain cases.
In the case of suspension due to illegal exit from the country, benefits will resume when the individual returns.
In the case of suspension due to a court declaration of missing or termination due to a court declaration of death, benefits will resume if the court cancels the declaration of missing or declaration of death.
In the case of suspension due to unverifiable recipient information, benefits will resume once the information is verified.
For the above three cases, when the regime is restored, the monthly social insurance benefits will be paid, including the amount for the period when the benefits were not received.
Additionally, in the case of suspension due to a written refusal to receive benefits, the benefits will resume if the individual submits a written request to receive benefits again.
In this case, the monthly social insurance benefits will be paid from the time the social insurance agency receives the request to resume benefits, excluding the amount for the period when benefits were not received due to the individual’s refusal.
One-time allowance for emigrants
According to Article 76 of the 2024 Social Insurance Law, people who are currently receiving monthly social insurance benefits and are emigrating abroad can choose to receive a one-time allowance. Accordingly, the one-time allowance is calculated based on the number of years of social insurance contributions, with each year of contribution before 2014 counting as 1.5 months of the current pension, and each year of contribution from 2014 onwards counting as 2 months.
