On April 15, 2025, Minister of Home Affairs Pham Thi Thanh Tra, Deputy Head of the Steering Committee for the Reorganization of Administrative Units and the Establishment of a Two-Tier Local Government Model (the Steering Committee), issued Document No. 03/CV-BCĐ. This document provides guidance on several tasks related to the reorganization of administrative units and the structure of local government. It was addressed to the Provincial Party Committees, People’s Committees of provinces and centrally-run cities.

Regarding the two-tier local government structure, the Steering Committee has provided orientations on the following aspects for the local government at the commune level (including communes, wards, and special districts): organizational structure, number of leadership positions, functions and tasks, proposed functions and tasks of specialized agencies under the new People’s Committee at the commune level, staffing, non-specialized staff at the commune and village/residential area levels, and public non-business units.

Specifically, for public non-business units, Document No. 03/CV-BCĐ states that the reorganization of these units under the current People’s Committee at the district level to transfer or establish new units under the People’s Committee at the commune level after reorganization should follow the orientations outlined in Conclusion No. 137-KL/TW and the guidance of the specialized management ministries in relevant fields.

Reorganization of Public Non-Business Units in the Fields of Healthcare and Education

Once the two-tier local government structure is operational, the Government will assign the Ministry of Home Affairs to coordinate with relevant ministries and sectors to develop and submit to the Government for amendment, supplementation, or promulgation of new regulations related to the organization and operation of non-business units. This will ensure their effective operation and meet the demands of the people. Specifically:

In the field of education: Maintain the current public secondary schools, primary schools, and kindergartens, and assign them to the local government at the commune level for management.

Vocational education centers and continuing education centers under the current People’s Committee at the district level will be transferred to the management of the Department of Education and Training and reorganized to provide services on an inter-commune or inter-ward basis.

In the field of healthcare: Maintain the current commune health stations to meet the healthcare needs of the people in the area.

Based on the area and population scale of the new administrative unit at the commune level, the People’s Committee at the provincial level may reorganize them into a single public non-business unit directly under the People’s Committee at the commune level to carry out tasks related to disease prevention and primary healthcare for the local population.

Regarding district-level polyclinics and general hospitals, they will be transferred to the management of the Department of Health and reorganized to provide services on an inter-commune or inter-ward basis.

Reorganization and Operation of Public Non-Business Units

Reorganize and operate a single public non-business unit under the People’s Committee at the commune level to provide essential public services in areas such as culture, sports, tourism, information, communication, agriculture, and the environment to the local population.

Reorganize and operate a single self-financed public non-business unit (Project Management Unit) under the People’s Committee at the commune level to provide public services in the fields of construction, land fund development, and site clearance.

If necessary, the People’s Committee at the provincial level may establish a non-business unit under the Project Management Unit of the People’s Committee at the provincial level to provide services on an inter-commune or inter-ward basis.

Assign the People’s Committee at the provincial level to restructure or dissolve public non-business units that are operating inefficiently, ensuring improved quality in the provision of essential public services. This is in line with Resolution No. 19-NQ/TW dated October 25, 2017, of the 6th Plenum of the 12th Party Central Committee on continuing to renew and improve the efficiency of public non-business units.
