According to the Quang Ninh Provincial Police, the provincial People’s Court has just conducted an appeal trial for Vu Thuy An (born 1989) on the charge of “Abuse of trust to appropriate property” as stipulated in Article 175, Clause 3 (with the corresponding framework circumstance specified in Article 175, Clause 1, Point a) of the Criminal Code.
Per the indictment by the Quang Ninh Provincial People’s Procuracy, Vu Thuy An got acquainted with Tran Thi Lan via Facebook. An introduced herself as a freelance real estate broker to Ms. Lan.
In early March 2022, An informed Ms. Lan about several apartments in the Vinhomes Golden Avenue project, located in Bac Luan II Ward, Hai Hoa Ward, Mong Cai City, Quang Ninh Province, which would be launched in April 2022. An proposed that if Ms. Lan intended to purchase, she needed to make a deposit of VND 105,000,000/apartment. An assured Ms. Lan that when the project was officially launched, she would accompany Ms. Lan to sign contracts with the investor. In case the purchase was unsuccessful, An promised to refund the money. Ms. Lan agreed.
From March 22 to March 29, 2022, in Cam Thanh Ward, Cam Pha City, Tran Thi Lan and Vu Thuy An reached an agreement. Ms. Lan transferred VND 525,000,000 to An to help her make deposits for five apartments in the Vinhomes Golden Avenue project (in fact, at that time, the project had not yet been formed and the State had not approved the land allocation for the investor to implement the project).
After receiving the money, An only returned VND 40,000,000 to Ms. Lan, even though she could not fulfill their agreement. An then intentionally appropriated the remaining VND 485,000,000 for personal spending, despite having the conditions and ability to refund Ms. Lan.
On November 17, 2022, Ms. Lan reported An’s criminal acts. Later, on August 22, 2024, An’s family returned VND 485,000,000 to Ms. Lan as compensation. Ms. Lan petitioned for a mitigated punishment for An. The accused, Vu Thuy An, persuaded her family to compensate Tran Thi Lan VND 485,000,000, and Ms. Lan had no other requests.
In the first-instance trial in March 2025, the Court sentenced Vu Thuy An to five years and six months in prison for “Abuse of trust to appropriate property” as stipulated in Article 175, Clause 3 (with the corresponding framework circumstance specified in Article 175, Clause 1, Point a) of the Criminal Code.
However, in the appeal trial on May 16, 2025, considering the defendant’s sincere confession, remorse, and difficult family circumstances, the Court amended the first-instance verdict, reducing An’s prison sentence to four years and six months, a one-year reduction compared to the previous sentence.
According to information from Vinhomes, the Vinhomes Golden Avenue project was officially launched on August 17, 2023. In 2024, Vinhomes’ sales of inventory from this project reached VND 4.2 trillion, out of a total of VND 73.2 trillion across all projects.
