The proposal was made by Minister of Construction Tran Hong Minh in the draft Law on Railways (amended) presented to the XV National Assembly this afternoon (May 27).
Regarding investment in the development of railway infrastructure, according to the Minister, the draft law supplements regulations to mobilize local and other economic sector resources to participate in the construction of railway infrastructure.
This includes encouraging all organizations and individuals to invest in the development of railway infrastructure through various contract forms (BT, BOT, BTO, BLT, BTL…).

The draft law also stipulates that the Provincial People’s Committees can decide to implement the construction of urban railway projects without having to go through the procedures for investment policies. This additional regulation is a breakthrough solution to remove bottlenecks in the order and procedures for investing in the local urban railway system.
At the same time, the draft law also supplements regulations on local budgets being used for compensation, resettlement support, and investment in the construction of some items of national railway infrastructure.
Another new content mentioned by Minister of Construction is the amendment of regulations clarifying the responsibilities of subjects in the investment and construction of national railway projects, local railways, dedicated railways, and technical infrastructure connecting with railway projects, and the sharing of national railways with local railways and roads.
To shorten and simplify the implementation procedure, the draft law has supplemented the provisions for the application of Front End Engineering Design (FEED) instead of the basic design in the feasibility study report.
On the other hand, the draft law supplements regulations on the exploitation of land funds in the vicinity of railway stations to institutionalize Conclusion No. 49 of the Politburo to maximize resources for the development of railway infrastructure.

Reviewing the draft law, Mr. Le Quang Huy, Chairman of the National Assembly’s Committee for Science, Technology, and Environment, said that regarding the planning of the railway network, railway lines, and railway stations, the Committee suggested reviewing and clarifying new and different contents compared to the provisions of the Law on Planning.
If there are no new contents, the Chairman of the Committee for Science, Technology, and Environment proposed to refer to the Law on Planning for implementation to ensure consistency and compliance with the legal system.
Regarding the investment in the construction of railway works and the exploitation of the land fund in the vicinity of railway stations, according to Mr. Huy, some opinions agreed with the Government’s presentation on the mechanism and policy to remove bottlenecks in the order and procedures for investing in the local urban railway system to contribute to the realization of the goal of completing the urban railway system in Hanoi and Ho Chi Minh City by 2035.
On the other hand, some other opinions proposed to report and seek the opinions of competent authorities on the mechanism and policy to ensure strictness, conformity with the Party’s regulations and the laws of the State, and improve the quality and transparency in law-making.
