
Accused, Ha Thanh Hang
Ha Thanh Hang, a real estate broker, received a total of 3.5 billion VND as a deposit from two clients, Ms. H.D.T.N and Mr. N.V.S, for the purchase of land in the Vinaconex project in Mong Cai.
Specifically, at the beginning of 2022, Hang drew up contracts and received 2.1 billion VND from Ms. N for the transfer of land lot OLK36, and 1.4 billion VND from Mr. S for the purchase of land lot OLK06.
Subsequently, Hang asked Mr. M.D.L (born in 1978, residing in Ngoc Ha, Ba Dinh, Hanoi) to introduce and handle the transfer of a total of 4 billion VND (2 billion VND each) to Ms. T (born in 1989, residing in the Diplomatic Corps area, Xuan Tao, Bac Tu Liem, Hanoi) and a real estate company in Hanoi as a deposit for the purchase of the land lots as requested by Ms. N and Mr. S.
However, in February and May 2022, Hang proactively requested Ms. T and the company to return the total amount of 4 billion VND, citing personal use as the reason.
Thereafter, Hang failed to inform Ms. N and Mr. S about this, nor did she attempt to renegotiate with the developer. Instead, she provided false information to conceal the truth and showed signs of appropriating the entire 3.5 billion VND from the two clients for personal use.
Based on the collected evidence, on May 20, 2025, the Investigation Police Agency of Quang Ninh Provincial Public Security issued a Conclusion of Investigation, proposing the People’s Procuracy of Quang Ninh Province to prosecute Ha Thanh Hang for the crime of “Abuse of trust to appropriate property” under Article 175, Clause 4 of the Penal Code.
