On June 10, continuing the agenda of the 46th meeting, the National Assembly Standing Committee (NASC) discussed the absorption, explanation, and amendment of the draft Law on Amending and Supplementing a Number of Articles of the Law on Planning.

Speaking at the meeting, National Assembly Chairman Tran Thanh Man requested the drafting agency to send the drafts to local authorities for further contributions before submitting them to the National Assembly for approval in the second phase of the 9th session.

According to the National Assembly Chairman, the spirit of this law amendment is to immediately address issues related to administrative boundary changes and provincial mergers. He emphasized the need for a practical and flexible approach to ensure smooth implementation upon the law’s enactment.

He also highlighted the importance of integrating planning to avoid contradictions and overlaps. As an example, he referred to the integration of planning between Da Nang and Quang Nam following their merger and the subsequent steps needed for implementation.

Regarding decentralization and devolution in planning, Chairman Tran Thanh Man stressed the need to grant authority to the provincial level while ensuring supervision and inspection. He emphasized that provinces should not have unlimited autonomy without central government oversight.

Chairman Tran Thanh Man also requested clarity on whether existing bottlenecks are due to the law or decrees and circulars. He aimed to prevent potential obstacles in the law’s implementation, despite meticulous amendments.

Providing clarification on certain aspects of the draft law, Minister of Finance Nguyen Van Thang stated that the current revisions primarily focus on administrative boundary changes and provincial mergers, as well as the transition from a three-tier to a two-tier local government model. He noted that a comprehensive review and amendment would follow the mergers.

According to current regulations, only the approving authority can adjust the planning. Therefore, Minister Nguyen Van Thang argued that the authority is centralized at the central level since provincial planning is approved by the Prime Minister.

He emphasized the necessity of decentralization and devolution to provincial authorities to promptly address practical obstacles. Additionally, he mentioned addressing bottlenecks in certain specialized planning areas to facilitate local project implementation.

The Ministry of Finance, led by Minister Nguyen Van Thang, has already drafted a decree and is collecting feedback from ministries, sectors, and localities for timely issuance after the National Assembly passes the law. The drafting agency will continue to engage with local authorities to identify and address challenges for a smoother implementation process.

Concluding this agenda item, Mr. Vu Hong Thanh, Vice Chairman of the National Assembly, clarified that the scope of the law amendment focuses on addressing urgent issues as per the conclusions of authorized agencies. These amendments aim to facilitate the arrangement of a two-tier local government model.

Mr. Vu Hong Thanh acknowledged that planning-related bottlenecks are not limited to this law but also involve other laws, such as those on land, urban areas, construction, geology, and minerals. He emphasized the need for a comprehensive review and evaluation over time. The NASC requested the drafting agency to thoroughly review and absorb opinions, providing clear explanations for the absorbed content and highlighting any new additions.
