Information at the Government’s regular press conference in January 2024 on solutions to ensure smooth implementation and plans, programs for building documents under the law to ensure immediate enforcement after the law takes effect. According to Deputy Minister of Natural Resources and Environment Le Minh Ngan, the workload in preparing the necessary content to ensure the effective implementation of the Land Law 2024 from January 1, 2025 is very large and the Ministry is currently focusing on promoting 4 groups of tasks.
The first group of content is the organization of building detailed regulations guiding the implementation of the Land Law. The Land Law (amended) has stipulated the content under the jurisdiction of the Government, the Prime Minister, the Minister, the provincial People’s Council, and the provincial People’s Committee. Accordingly, the plan has thoroughly reviewed the points and provisions in the Law assigned by the Government to issue detailed regulations.
According to Deputy Minister Le Minh Ngan, there are currently 9 Decrees expected to be issued. In which, the Ministry of Natural Resources and Environment will directly propose the Government to issue 6 Decrees, the Ministry of Finance will propose the issuance of 2 Decrees, and the Ministry of Agriculture and Rural Development will propose the issuance of 1 Decree. It is expected that 6 Circulars will be issued, including 4 Circulars of the Ministry of Natural Resources and Environment, 1 Circular of the Ministry of Finance, and 1 Circular of the Ministry of Home Affairs. There is a Decision of the Prime Minister to be proposed by the Ministry of Labor – Invalids and Social Affairs.
For local authorities, there are 18 content items under the jurisdiction of the provincial People’s Committee that must stipulate in detail, and 1 content item under the jurisdiction of the People’s Council to issue. The plan clearly stated, clearly distinguished, and set a time to prepare.
According to Mr. Ngan, along with issuing guiding documents for the implementation of the Law, the task of assigning agencies, ministries, and localities to review existing legal documents to ensure consistency and uniformity with the amended Land Law, including laws related to land that we have not directly amended with the Land Law, will continue to be reviewed to ensure consistency.
The second group of content, according to Mr. Ngan, with decrees related to land management, related ministries and departments also continue to review. Localities also continue to review the regulations, documents, and legal normative documents under their jurisdiction, to amend, supplement, and issue to ensure consistency and uniformity.
The third group of content according to Deputy Minister Le Minh Ngan is preparing for the organization of dissemination of the basic contents of the Land Law and guiding documents for implementation. The Ministry of Natural Resources and Environment has developed a plan for popularizing, propagating, and guiding the law, coordinating with central authorities, departments, and ministries and press and media agencies to disseminate to the truly affected subjects of the law. How to make the new points of the Land Law, the content of the Land Law and the guiding documents for implementation known to the law-affected subjects and the whole people, the management process and organization of implementation of state management agencies, as well as people and businesses, are most convenient, ensuring feasibility.
The fourth group of content, according to Deputy Minister Le Minh Ngan, the Ministry of Natural Resources and Environment has plans to implement measures and resources to implement the Land Law, propose to the Government to concentrate resources to implement state management contents such as: Building a land database, basic land investigation and assessment, maintaining the land information system. For localities, resources are also focused, first of all, for land development funds to ensure the creation of land fund to implement land use evaluation, construction of infrastructure for resettlement areas…
Furthermore, the Ministry of Natural Resources and Environment also directed and coordinated with localities to organize the construction of land databases at the grassroots level, connecting with the land database at the central level, ensuring consistency, uniformity, and connection with other national databases. Ensure that the Land Law and guiding documents for implementation, as well as new policies, are implemented in a unified manner after the law takes effect.
