A decree stipulates that high-tech parks are privileged investment areas, enjoying investment incentives applicable to areas with special difficult socio-economic conditions under the investment legislation. The specific incentives and support for investment projects and activities in the high-tech park are applied according to the investment legislation, corporate income tax regulations, export and import taxes, land, credit, and related laws.
The high-tech park management board and relevant authorities are responsible for carrying out administrative procedures in investment, business, land, construction, environment, labor, tax, customs, and related processes according to the one-stop, one-gate mechanism as prescribed by law; providing support for labor recruitment and other related issues during the implementation of activities in the high-tech park.
Investment projects and activities in the high-tech park are prioritized for participation in training and labor recruitment support programs, high-tech research and application programs, technology transfer programs, high-tech industry development programs, high-tech agriculture development programs, innovation and start-up support for enterprises, and government, ministry, and local programs for loan and support.
A decree encourages state agencies and individuals with sufficient experience and capacity to participate in the construction and operation of the infrastructure system of the high-tech park, including investing in the construction and operation of the entire technical infrastructure system of the high-tech park or a part of the technical infrastructure system of the high-tech park as stipulated in Article 23 of Decree No.10/2024/ND-CP.
Investment projects for the construction and operation of infrastructure are entitled to incentives on land rent, compensation money, land clearance reimbursement as prescribed for land rent within the high-tech park. Investment projects for the construction and operation of the infrastructure of the high-tech park are prioritized for credit investment loans from the State, implementing legally authorized sources of capital according to enterprise legislation, credit legislation, and other related laws.
The high-tech park management board and related agencies are responsible for prioritizing the resolution of administrative procedures related to infrastructure investors and investment projects in the investment and business infrastructure investment area to ensure favorable conditions for attracting investment and other activities of the infrastructure construction and operation investment project.
In addition to the above-mentioned incentives and investment support as stipulated in this Decree, export-processing enterprises in the high-tech park as prescribed in Clause 2 of Article 32 of Decree No.10/2024/ND-CP, when meeting the customs supervision and inspection conditions, enjoy specific regulations for export-processing enterprises operating in industrial parks and economic zones as stipulated by the laws on industrial parks and economic zones.
The provincial People’s Committee is responsible for planning residential areas and social infrastructure system right adjacent to or around the high-tech park, ensuring convenient transportation connections to directly serve employees working in the high-tech park while determining the high-tech park development plan when provincial planning is made and ensuring appropriate investment in accordance with the needs, construction progress of the high-tech park.
The state encourages organizations and individuals with sufficient experience and capacity to participate in the construction and business of social infrastructure. Social infrastructure includes cultural facilities, parks, gardens, trees, and amusement areas for public purposes (except for specialized amusement areas, parks with a density of combined architectural structures over 5%), invested through public-private partnerships or by socializing capital, voluntary contributions from organizations and individuals.
Investment projects for residential construction, service facilities, and public utilities serving employees working in the high-tech park enjoy preferential policies and support as prescribed by laws on social housing construction and related laws. Individuals are leased, purchased, leased-to-purchase homes, and accommodation facilities serving employees in the high-tech park.
In the case of high-tech parks where the State budget invests in the construction of the technical infrastructure system, the zones with high-tech research and development functions, high-tech enterprise incubation, and high-tech human resource training are guaranteed State budget investment for land clearance, land reclamation, and synchronized construction of the technical infrastructure system.
The State budget prioritizes the construction of research and development facilities, large-scale laboratories meeting international standards for research, analysis, testing, standardizing; high-tech incubators, high-tech business incubators; high-tech human resources training facilities; high-tech information infrastructure to facilitate access, use, and exchange of high-tech information by organizations and individuals.
The State prioritizes the use of ODA development assistance, preferential credit sources, and technical assistance under other regulations, resources from national programs on science and technology development, high-tech, development support, and other legal resources for investment in research and development facilities, high-tech incubators, high-tech business incubators, high-tech human resources training facilities; support projects, research, and development activities, high-tech incubation, high-tech business incubation, and high-tech human resource training…
In addition to the incentives and investment support provided for in this Decree, exporting enterprises within the high-tech park stipulated in Clause 2, Article 32 of Decree No.10/2024/ND-CP, which meet the customs supervision and inspection conditions as specified in the regulations for tax-free zones, are subject to the separate regulations for export enterprises operating in industrial parks, economic zones as stipulated by the laws on industrial parks, economic zones, from the date the enterprises meet those conditions.
This Decree takes effect from March 25, 2024.
