The fee collection organization as stipulated in this Circular is the competent authority to provide measurement data and map information as prescribed by the law on surveying and mapping.
The fee collection organization is deducted 60% of the fee amount collected to cover the costs of providing services, collecting fees and contribute 40% to the state budget; unless otherwise provided below.
In case the fee collection organization is a state agency not covered by the cost account from the fee collected under the provisions at Clause 3, Article 1 of Decree No. 82/2023/NĐ-CP, 100% of the fee collected must be paid into the state budget. The cost source for providing services, collecting fees is arranged by the state budget in the estimate of the fee collection organization according to the regime, the state budget ratio as prescribed by law.
Cases exempt from fees
The draft specifies that exemptions apply to cases where the Minister, Heads of agencies equivalent to ministries, agencies subordinate to the Government, Chairman of the provincial People’s Committees have written requests to exploit, use information, measurement data, and maps belonging to state assets to serve: a) National defense and security purposes in emergency situations; b) Prevention and control of natural disasters in emergency situations.
The emergency situation prescribed in this clause is determined according to the provisions of the Defense Law.
The fee amount equals 60% of the corresponding fee amount in the fee schedule issued with this Circular for cases where the Minister of Public Security, the Minister of National Defense, the Chairman of the provincial People’s Committees, the central city has written requests to exploit, use information, measurement data, and maps belonging to state assets for national defense and security purposes, except as specified above.
