Many social housing projects ‘neglect’ layout and violate land pricing
The Government Inspectorate has just issued its Report on the responsibility for implementing the law on inspection, citizen reception, settlement of complaints, denunciations and corruption prevention; land management, land use permits for the exploitation of soil and rock as construction materials; planning activities in Ninh Binh province.
In the inspection of 18 projects, the Government Inspectorate found some limitations, shortcomings, and violations.
Specifically, 7 projects have limitations, shortcomings, and violations in terms of planning work such as: approving incorrect scale planning, not adjusting general planning, planning indicators that are not suitable for higher-level planning or construction standards. Projects with a scale of over 5ha but without detailed planning of 1/500, without arranging social housing.
These projects include: Integrated tourist center and 54-hole golf course at Yen Thang Lake; Dong Thai eco-tourism area; Eastern bus station of Ninh Binh City; High-class wood processing factory in Xich Tho commune, Nho Quan district; Binh Minh residential area, Nho Quan district; Gian Khau industrial zone; New urban area in the north of Ninh Binh City and Hoa Lu district.
There are 7 projects that are behind schedule compared to the investment certificate, including: Dong Thai eco-tourism area; High-class wood processing factory in Xich Tho commune, Nho Quan district; Restaurants and production facilities serving tourism in Gia Vien commune, Gia Vien district; Ha Thanh comprehensive service and business area (Phuoc Loc); Tan An commercial and service center; New urban area in the north of Ninh Binh City and Hoa Lu district; Binh Minh residential area, Nho Quan district.
The Government Inspectorate also discovered 7 projects that have limitations, shortcomings, and violations in determining land use fees, land leasing, not determining additional land leasing fees (adjusting detailed planning, increasing floor area), late payment of land leasing fees, not adjusting land leasing prices after the stable 5-year period, exempting/reducing land leasing fees, including: Integrated tourist center and 54-hole golf course at Yen Thang Lake project; Tan An commercial and service center; General market at Ninh Binh City; 3 industrial clusters (Gia Van, Gia Phu, Khanh Thuong); Eastern bus station of Ninh Binh City.
In addition, land leasing prices and infrastructure fees in Gian Khau industrial zone are lower than the common ground level of industrial clusters in the area.
Through inspections, the Government Inspectorate also identified that at 5 projects, the investor received land use rights transfer without any permits from the competent authorities, including: General market at Ninh Binh City; Ha Thanh comprehensive service and business area (Phuoc Loc); Restaurants and production facilities serving tourism in Van Gia commune, Gia Vien district; Ha Anh petroleum depot; High-class wood processing factory in Xich Tho commune, Nho Quan district.
There are 4 projects that violate construction order, including: Restaurants and production facilities serving tourism in Van Gia commune, Gia Vien district; Ha Thanh comprehensive service and business area (Phuoc Loc); Integrated tourist center and 54-hole golf course at Yen Thang Lake; Tan An commercial and service center.
The Eastern bus station of Ninh Binh City has not implemented the land use purpose transfer for a part of the area, 3,738m2.
There are 3 projects with limitations, shortcomings, and violations in the order and procedures when approving investment decisions, such as approving investment decisions without planning, land use plans, not suitable with the general planning of new rural construction, urban planning, zoning plan, including: Dong Thai eco-tourism and Golden Cuc Phuong villa project; Eastern bus station of Ninh Binh City; High-class wood processing factory in Xich Tho commune, Nho Quan district.
There are 5 other projects with limitations, shortcomings, and violations. Specifically, regarding compensation and ground clearance support: Dong Thai eco-tourism and Golden Cuc Phuong villa project; non-payment of land leasing fees: Anh Duong Infrastructure Investment Joint Stock Company, leasing land in Gian Khau industrial zone (after the inspection, the company has paid the land leasing fees according to the notification of the Tax Department); late payment of M3 fees: New urban area in the north of Ninh Binh City and Hoa Lu district, Binh Minh residential area, Nho Quan district; late determination of land leasing prices, signing land leasing contracts: Integrated tourist center and 54-hole golf course at Yen Thang Lake project.
The industrial park owner has leased land without being granted land ownership certificate
The inspection report also clearly stated that at Phuc Son industrial park, where Phuc Loc Industrial Park Development Investment Joint Stock Company is the investor, Ninh Binh Provincial People’s Committee approved the investment decision and the Industrial Park Management Board issued investment certificates for 4 commercial and service projects that were not suitable for detailed plans, failing to ensure the requirements of the Construction Law and the Investment Law.
The Ninh Binh Provincial People’s Committee leased land for 3 commercial and service projects that did not comply with the land use plan, violating the Land Law.
The infrastructure investor of the industrial park was concluded to have not fulfilled the financial obligations and had not been granted a land use rights certificate but had subleased the land, violating the Land Law.
The Industrial Park Management Board issued investment certificates for 6 projects in the industrial park that did not meet the dossier requirements according to the regulations of the Investment Law.
In addition, the Government Inspectorate discovered that the provincial Department of Construction advised the Ninh Binh Provincial People’s Committee to approve the list of land-use projects with investor selection for some urban projects not under its jurisdiction, violating the Government’s Decree No. 30/2015.
